I would think a manufacturer of any product they deemed dangerous in any way would be kept by them, think about it. If they knowingly sent you back something that might hurt someone or cause liabilty damage then they would set themselves up for a massive lawsuit. Much easier to fight you in court, where you'd hope to win the actual value of that item, or what the court would consider a suitable replacement.
