It has to have a serial number, you can't sell it without a manufacturers license, and some states require a FFL for transfer to another person just as any firearm. But if you have access to the materials and equipment, machining your own lower is perfectly legal. 80% lowers (not 80% of lowers) are sold using this this concept.
