From the Constitutional purist point of view any testing requirement comes with the potential to be abused. I liken it to literacy tests for being able to vote. Too much room for abuse in the wrong hands.

Again--good point but--here in Texas-most of our Politicians have something that many outside the State do not--it's called: Common Sense.
Im certainly no know-it-all-nor an expert on laws but-do know they have here at least a few "common sense" laws on the books.
One that gets me that is still on the list of laws in that little City I once lived in has been on the books since 1915. The law states: "It is against the law for two pigs to have sex on the street." Yes--that IS an actual law still on their books there.
