Illinois Governor Pat Quinn signed a gun-control measure into law on Sunday that expands background checks to cover all firearms purchases in the state, closing what he said was a loophole that exempted gun sales between private parties.

Under the new law, gun sales or transfers between private parties, including those that take place online, will have to have background checks .

The new law also requires all gun owners to report any lost or stolen firearms to local police within 72 hours.

The expanded background checks go into effect on January 1, 2014.

Sure you will, doesn't go into effect until 2014. I do agree that Illinois is beyond foolish though.

That's good news. All I have to do now is scratch or grind off a few serial numbers and put the shooters in the bottom of the tomato basket and I'm good to go. Don't tell everybody, but, the sentence used to check them out is " Do the maters look good today?" I'm sure putting one over on Quinn! Ha-Ha!! Soon the crime wave will plummet.

This will have no effect on crime. Criminals don't go through back ground checks. Only law abiding people do. This will only make it harder for the good guys.

Does the new law include registration of guns? Assuming you (someone) has an unregistered gun or one registered to someone else, can you claim you bought it before the law went into effect?

I guess you can sell your gun in a private sale and afterward report it as stolen.

I wonder what dealers will charge to handle sales and do the background checks? Mine charges $15, I hear they charge $50 or more in CA

Illinois already requires individuals to obtain a Firearm Owners Identification (FOID) card issued by the Illinois State Police in order to legally purchase a firearm from dealer or private party. I haven't read the new law, but according to an article, private sellers now have to call a hotline to ensure the buyer's FOID card is valid. Sounds like just another hoop to jump through to discourage legal firearm ownership.

"sir, can i please see your FOID card before I can sell you this firearm. Thank you. Now I have to call a hotline to make sure this FOID card is valid"

Who will man this hotline? How long will it take seller to obtain FOID validation from the hotline? "Sorry all representatives are busy. The approximate hold time is 132 days. Thank you for holding." What info will this hotline collect?

I'm going to have to read the details of the bill.

So how well are all the existing laws working out in Chicago, which I understand doesn't even have one firearms dealer in the city?
Lets add some more laws....that will do nothing to curb crime..

Man walks into a store to purchase some beer. "Sir, I need to see your ID to verify your age. Thank you. Now I have to call a hotline number to verify your state issued ID is valid. This should just take a moment."

I suppose it's possible that some current FOID holders may have lost their right to own firearms due to recent criminal actions or mental issues. Honestly, I don't know how often IL residents need to renew their FOID. There may be a few instances where this law might prevent a private gun transfer to a recent criminal who also has a current FOID, but this would seem a rare scenerio.

Edit: Just read online that a FOID card is valid for 10 years.

Enforcement????? I don't live in IL so this might be considered moot, but I can say that if similar legislation was passed in my state I would more than likely ignore it. If the farmer down the road wants to sell me his old ******there is no reason to get the government involved. This type of legislation depends on the 'nation of sheep' philosophy. This is the same mentality that was tried on the citizens of this nation in the 1770's and thankfully, it didn't work. I am not espousing criminal activity here, just a return to common sense.

25elk, the problem will come from the Il.State Police who are commanded by democratic appointed leaders. There will be sting type operations and that will scare any number of good people into complying with more assinine laws designed to make firearm ownership harder and harder. While I have not yet read the new law, our local paper said in an article last night that you would have to call the state police and they would either confirm or deny the buyer having a valid FOID card, and catch this, sometime within a 30 day period after you make the initial call. In otherwords, it could take a month to sell your old shotgun to your next door neighbor. It is a shame we don't still tar and feather the scoundrels and ride them out of town on a rail.

Quinn was obviously conferring with Cuomo. ALL private sales, must go thru an FFL since Jan, 2013.
