Default Concealed Carry Bill Senate Bill 2188

Here is the link for the the NRA's article and info the bill. If it passes, you'll be able to carry in every state but IL. At the bottom there is a link that will send your Senators letters.
The 2nd Amendment needs all our support.

I hear you, but honestly as much as I'd like to see this happen I really don't think it's going to pass in the Senate, if it does you know Obama will veto it. Perhaps the next administration, that is if there is still a Constitution in place.

This won't right now, but should in the future. When the Federal Judge in MD said the handgun law was unconstitutional. NJ of course has that exact requirement to show a 'demonstrable, justifiable need', (my words, can't remember exact phrase). If the federal courts uphold the judges rulling we can hopefully get NJ's law changed.

A nearly identical bill had bi-partisan support a few years ago. It was an election year for the Senate Majority Leader and he allowed it to be brought up for a vote to help solidify his 2A creds. It that case above, the bill was added as an amendment to a Defense Auth bill.

The makeup of the Senate may have changed enough to garner the two extra votes to break a filibuster, but since the Senate Majority Leader isn't up for re-election this cycle, I am concerned that he may not allow it to come to a vote. A veto in an election year could be fatal to the Executive Branch incumbent and the Senate Majority Leader may provide cover by blocking a vote. To this end, the NRA is encouraging members to contact their Senators to push for a vote.

Yes, but it really depends on which federal judge it goes before, just last month another federal judge ruled in the nj2as/anjrpc suit the exact opposite. Eventually this will need to end up at the Supreme Court level.

If it passes the Senate, and there's a good chance it will as discussed above, then obozo will have two options:

- Sign it and piss off his base just before the election

- Veto it and piss off most Americans just before the election.

Either way is a win in my book. The bigger win is the first, of course.

This bill will not solve every states problem with CCW. However, it will be a huge win for gun owners all across the state. This bill could be the catalyst for a lot more Constitutional Carry across the nation. Good stuff!

There is a thrid option. He could do what Nixon did with most Environmental legislation. Let it set on his desk until it becomes law. That way he can tell his base: It's not my fault, I didn't support the bill but the Congressmen that YOU elected said it was "The will of the people".

Then he can tell everyone else: "See, I didn't oppose this bill did I? Why do you think I would pass additional firearms legislation in my next term if I didn't veto this bill?". It could be a win/win for Obama depending on how the Spin Doctors handle it.

The NRA is not going to let him slide on this. The heat the NRA puts on this will be huge. Instead of all of the theorizing, how about we go and send the letters to the Senate, then theorize?

It never ceases to amaze me. The need to fight for a right granted by our own constitution. And judges that say we must demonstrate a "need" to do so. By that logic the judge could say we have to demonstrate a need for free speech, or freedom of religion.

Is there something in this law that will prevent the Feds from making regulations controlling how states license gun owners? It seems to me that if this becomes law, it will invite the feds to create regulations governing the movement of guns between states much like how the feds set standards for CDL drivers. This could end up not being a good thing for us.

Good ?

The Senate bill has not been crafted fully, that's part of the NRA generated letter, requesting it mirror the House bill, which merely says all states must recognize each others carry permits. No where does it state the Federal Government has any role in issuing or governing permits or give it the authority to ever do so.

I'm sure that the interstate commerce act will be brought into play just like it is with every other law requiring reciprocity between states for anything. I just hope that we don't end up with a situation where the executive branch is able to regulate gun possession between states without legislative input. I think a much better method is for each state to pass own reciprocity laws like what seems to be the present trend in some parts of the country. As good as this law seems to be, I can see a real potential for abuse if it is not constructed correctly.

I can't help but WORRY that a federal law of this type will invite EVENTUAL intervention to standardize all of the state carry laws. I doubt that they'll pick VT for their model.

It would also appear to get the 'camels nose under the tent' regarding ACCEPTANCE of a federal role in providing us with our rights...first to carry, then to own.

Perhaps I worry too much.

Personally, I don't think it would ever come to a vote in the Senate.

PS: I live in MA, and DO have an unrestricted LTC, FWIW.
