That kind of opens up another can of legal worms.
In our state you have to be confronted with deadly force or be afraid for your life (or another's).
If it's on your own property and the "perp" is armed the rules are slightly relaxed but shooting someone in the back is never gonna fly as I read things.
Luckily we now have a shall issue CCW and even a sort of campus carry (the grounds but not the buildings).
There is work being done for a full campus carry but as expected resistance is high from the ivory tower.

makes it sound like the thief may not have been armed.
