Gov. Abbott Signs Constitutional Carry Bill

Yesterday, June 16, Texas Governor, Greg Abbott, signed the Constitutional Carry Bill into law. It takes effect on September 1, 2021.

I urge all fellow Texans, and visitors who intend to carry, to read a good and well-prepared interpretation of the new law. Texas Law Shield has an excellent synopsis outlining similarities between permitted carry and Constitutional carry - there are similarities and some important differences. I'd love to list the comparisons but I am not an attorney and never played one on T.V. either.

Permitted carry allows more flexibility in more situations including some where Constitutional carry is not legal but permitted carry is. There is no provision in the new law requiring a person be a Texas citizen/resident to exercise Constitutional carry options within Texas' borders.

Personally I believe there are compelling reasons why Texas residents might prefer to opt for a Texas CHL rather than rely on Constitutional carry but to each his/her own. I certainly intend to maintain my Texas CHL.

Excellent. Not super familiar with Texas carry laws, but where/when in Texas is there a distinction drawn between constitutional/permitted carry as far as legality, asides from reciprocity outside of TX?

As a "non-attorney" I really don't want to list the compare and contrast list...but here's a sample taken from the Texas Law Shield publication I received.

Texas Constitutional Carry pertains to handguns only.

Legal signage prohibiting "non-licensed carry" is much more relaxed (just about any old sign will do) whereas signage indicating prohibition of CHL carry is very specific and must cite state statute. The supposition is that there will be places, private property, that welcome licensed carry that will exclude permit-less carry and they're making that distinction easy.

Texas CHL required for reciprocity as you mentioned.

CHL can carry within a 1000 foot radius of a school (with exceptions) and non-permitted cannot.

Must be 21 years of age for unlicensed carry and Texas issues CHLs to certain individuals of age 18-20.

Texas CHL holders are allowed "oopsies" at airports as long as they agree to leave the "secured" premises (security line) immediately with their weapon. Otherwise a felony.

This is not an exhaustive list and I encourage you to read the regs yourself to stay out of trouble. As I've mentioned before; one of the most important reasons I'll always have a Texas CHL is that it puts you in the security express lane at the Capitol. This can be a big deal if you're running late, or even on-time, and end up behind three busloads of middle-school field trippers. Don't ask me how I know this.

Bryan you hit the nail on the head with signage. I visit a food/bar place that has a sign barring people without licensing from carrying guns. I noticed this weekend in Oklahoma City and how simple their signs where. For me I will keep my LTC, I like not having a background check when purchasing fire arms.
