Default Can I ship ammo to NY State?

Can I ship ammo directly to a customer who lives in NYS or do I need to go through a FFL?

A guy bought some rifle ammo and I'd like to now the correct answer, so I didn't ask him nor a FFL there. I did however try to search the internet (50/50 which is not good enough), I searched on the NY SAFE Act website (no info found), called the NYPD (no one answered the phone, it's a robot) and also called the County Sheriff the customer lives in.... twice... also no one answered the phone.

Can someone help me out please?

If I remember correctly that requirement was predicated on the NYSP or the Feds, setting up a BGC for ammo.

Many businesses got scared to death and stopped shipping into NY. A few did, and still do, since no BGC system every got off the ground. I think the Feds told NYS that they didn’t have the manpower to do checks on ammo.

The powers that be got what they wanted anyways since most distributors would not ship into the state except to an FFL or not at all.

AFAIK it’s ok.

There are many ammo suppliers shipping into NYS. Target Sports being one. Check them out and if there OK you should be also. You mentioned customer are you a legitimate dealer licensed to sell ammo, that might make a big difference!

You mentioned the NYPD that is for the CITY, they many times have much more rules and regulations that upstate does.

Outside the 5 Burroughs of NYC it is perfectly legal to ship ammo to a customers door in NY.

Buds also ships ammo to NY.

Thank y'all for the reply's. Funny, the NYPD was the first that came to mind... I mean someone's got to know something, right?!

Anyway, no answer from my emails to the Sheriff's office.

I'll send the ammo. It's America and we all need to support those tyrannical states and their power hungry rulers.

No political discussion please, we all know we have been infiltrated by the enemy.

Most everyone seems to thumb their nose at the SAFE Act here as far as ammunition sales go. Many on-line sellers are shipping right to peoples home addresses.

But AFAIK, the SAFE Act as written has not changed. It originally said that anyone that sold ammunition had to be registered with the NYSP. Any FFL (o1) in NYS was automaticly registered and recieved a 'Seller of Ammunition' license in the mail shortly after the law was signed.
I can atest to that. If you were not an FFL and want to 'sell ammo' you could and still can simply apply for such and they will send you the license.

The plan which never has taken shape was that ammo sales were all to be done in person and only through one of these licensed ammo sellers.
They would do a background check and paperwork not unlike a NICS check on the buyer,,the check going through a NYSP data base.
That was the idea back in 2014.
Still waiting for that Data Base to be established.

But the law has not changed as written.
It still forbids anyone to sell ammo w/o that State Police License.
Shipments from out of state have to go to an FFL or someone with the Ammo Sellers licence in NYS for their (re)sale/transfer to the buyer.
All of course with that background check that has never happened in mind.,,,But they're working on it!!

So, No, internet sales and shipments of ammo to an individual in NYS are actually not allowed.
The person receiving the ammo in NYS has to have a 'Seller of Ammo' NYS license.

Same with gunshows, ammo for sale on a table is supposed to be sold by a person with such a license.
Does that happen,,sometimes,,some times not.

Just like some people bother to get an FFL to buy and sell guns.
Others just set up show after show after show without an FFL and an ever changing 'private collection' for sale.



Here's a swipe from a NYSP guide:

2) The law requires that as of January 15, 2014, all ammunition transfers take place in person, including internet sales, which must be facilitated by a New York State ammunition seller. However, organizations that distribute ammunition on their premises may register to continue to receive direct shipments of ammunition. Registration forms are available at NY SAFE Act | Safe Act. This type of registration may be of particular interest to shooting ranges, hunting clubs, and youth safety and education programs, as it will allow those groups to continue to receive discounted ammunition directly from the manufacturer.

It's just that,,a Memorandom of Understanding.
signed betw the Democrat majority NYS Assembly and the (at the time) NYS Senate Republican majority.
The Data Base would not go further until such time as it could be sufficiently funded and the technology was there to support it.

All it takes to change that and put it back on track is an OK vote by the Senate, Assembly and then the Govenors signiture.
They are all Democrate now so the Memorandom of Understanding can be nullified most anytime if all the party members play along.

I don't think they will simply because they don't want to raise a 2A debate over ammunition sales which don't seem to be a crime problem they can run with.

I looked into this when I wanted to buy some ammo in the Classifieds here. To be completely within the law, you should ship it to an FFL dealer. He/she may then transfer it to the end user.

Ship the ammo and don't be scared into complying to something with zero power. Anyone saying well technically you need to do this or that, you are playing right into the Dems hands. Using fear and sketchy, unclear rules to push their narrative. Just like the people who still say we are only allowed to load 7 rounds in our mags...
