I finally found a well-worn, (carried a lot shot a little.) M-19 4" to be used as a platform for my Barbeque/Saturday night dress up gun. Paid for it, and had it shipped to my FFL. All permits in order and a paper work filed out. FFL advised me that when he did the phone check, my Ok to buy was delayed, and no reason was given. Now I have to wait until the 25th to pick it up.
My background information: 27 years LEO, one arrest for simple assault 40 years ago, that was Monty Hauled to harassment 6 months unsupervised probation $100.00 fine then record sealed.
Has anyone else had anything like this happen or have any idea why this may have happened?

MANY reasons can apply.
If your name is John Smith, count on always being delayed, because the same name as yours that has a record can sometimes be the problem.
Probably nothing but a record problem like the above that has to be checked further.

In many states, the carry permit is recognized as an exemption for a background check. I suppose that is not the case in your state?

In divorces its almost proceduer to get a restraining order. That can goof you up too.

In Florida, the State Police do the check if you have a permit and never had a problem.:)

Not what I mean.
In Georgia, if you have a carry license, there is no background check. The dealer simply writes the license number and dates of issue and expiration on the 4473, and it is cash & carry.
Almost like a free country. :D

Lee, it is the case here in NC, I just have never bothered to get one, as I've always had my retirement credentials, I know most of the local guys, and I don't carry full time. I guess I better plan on starting the long and drawn out process of getting my CCW.

Why is it long and drawn out in NC? My last renewal took 45 minutes. My daughter and niece applied together for their permits a couple of months back, and had their permits in their grubby little paws in less than 72 hours. Y'all need a state organization like our GeorgiaCarry.org to light a fire under some legislators, who in turn should light a fire under county/municipal officers who are in charge of the permits.

The same is true here in Texas. At the time of transfer or purchase, you present your CHL, the ID number and dates are recorded, and you walk out with the gun.

If I go during the morning rather than after lunch, I'm usually approved on the spot. I've also learned that some FFLs won't or don't reveal that you have a CCP even though I show it with each purchase. This has also caused a delay. I hope this helps.

A delay response from the NICS Section indicates that either you or another individual with a similar name and/or similar descriptive features (name, sex, race, date of birth, state of residence, social security number, height, weight, or place of birth) has been matched with either state prohibitive criteria or one or more of the following federally prohibitive criteria:

■A person who has been convicted in any court of a crime punishable by imprisonment for a term exceeding one year or any state offense classified by the state as a misdemeanor and is punishable by a term of imprisonment of more than two years.
■Persons who are fugitives of justice—for example, the subject of an active felony or misdemeanor warrant.
■An unlawful user and/or an addict of any controlled substance; for example, a person convicted for the use or possession of a controlled substance within the past year; or a person with multiple arrests for the use or possession of a controlled substance within the past five years with the most recent arrest occurring within the past year; or a person found through a drug test to use a controlled substance unlawfully, provided the test was administered within the past year.
■A person adjudicated mental defective or involuntarily committed to a mental institution or incompetent to handle own affairs, including dispositions to criminal charges of found not guilty by reason of insanity or found incompetent to stand trial.
■A person who, being an alien, is illegally or unlawfully in the United States.
■A person who, being an alien except as provided in subsection (y) (2), has been admitted to the United States under a non-immigrant visa.
■A person dishonorably discharged from the United States Armed Forces.
■A person who has renounced his/her United States citizenship.
■The subject of a protective order issued after a hearing in which the respondent had notice that restrains them from harassing, stalking, or threatening an intimate partner or child of such partner. This does not include ex parte orders.
■A person convicted in any court of a misdemeanor crime which includes the use or attempted use of physical force or threatened use of a deadly weapon and the defendant was the spouse, former spouse, parent, guardian of the victim, by a person with whom the victim shares a child in common, by a person who is cohabiting with or has cohabited in the past with the victim as a spouse, parent, guardian or similar situation to a spouse, parent or guardian of the victim.
■A person who is under indictment or information for a crime punishable by imprisonment for a term exceeding one year.
A delay response indicates that information you supplied on the Bureau of Alcohol, Tobacco, Firearms and Explosives Form 4473 has been matched with information contained in the National Crime Information Center, the Interstate Identification Index, and/or the NICS Index. Complete disposition information is not always available and a further review of these records is necessary. The NICS Section exhausts all efforts to retrieve current record information by contacting all applicable law enforcement agencies, i.e., local, state, and federal courts, etc. The Brady Handgun Violence Prevention Act of 1993 allows three business days to obtain this information before a Federal Firearms Licensee (FFL) can transfer a firearm. The FFL is not prohibited from transferring the firearm after three business days have passed; however, the FFL is not required to transfer the firearm.

It happens a lot here in Florida, some days your background check goes through some days there is a delay. As mentioned probably due to someone else with a common name or the lone background checker outer is off sick that day.;) They are not required to give a reason. You are not denied, just a hold and they have 3 days to to notify the FFL go or no go. If they do not reply to the FFL then you are good to go.

A CCW does nothing for the background check(in FL) only allows you to walk out with a handgun the same day (no 3 day wait)

No CCW and you can walk out with a 12 gauge, AR 15, AK or other assorted semi autos but not a 22 lr 2 shot derringer handgun.

My gun shop guy repeatedly asks me why I don't have a CHL...I do buy, sell, and/or trade a lot. (I don't own all that many at one time...I move them in and move them out.) I want my wife and I to get ours together, at the same time...and one thing or another has gotten in the way so far. However, we were talking about this tonight, and both agree that we want to get our licenses before the end of March. Once we do, I probably won't buy any more guns...now that it would be more convenient. :p

On the delay thing...it's never happened to me, but my LGS guy told me that he's seen it happen to a guy on one purchase, and not on the next. No real rhyme or reason, in many cases.

Today was a Holiday for some and not others, computer might be down or maybe it was brake time when they checked your information.

I'm one of those guys your LGS guy was referring to, so I always plan on being delayed.

Your Taxe$ at work: Last summer I was "delayed" buying a new revolver at one gunstore, stopped at a pawnshop on the way home and walked out with a used pistol, within an hour of being "delayed". If it had been the other way around, I might have seen some logic in it, but a "Delayed" followed almost immediately by a "Proceed" simply does not make any sense to me and I can make sense of almost anything even if I don't agree with it. (Studied Abnormal Psych to better understand politicians)

To the OP, welcome to my world. ;)
Once you've been "delayed", you will be again.

FFL friend of mine once told me that the cops are the ones who almost always get delays; something about their names being in several places in NICS/NCIC. Perhaps a grain of truth, I'm not sure. I know there's someone with a similar name/*** to me in Colorado with an outstanding warrant, but it's never slowed me down on purchases.

Definitely get the CCW permit to avoid it in the future (and my but I wish we had that in NY).

Hi:
The "Soundex" system at work. If your name is the same as a person with a criminal background, then a "Red Flag" pops up thus a delay.
In Florida a Black Male in Orange County was constately being arrested for Domestic Battery. I am a White Male and a LEO. The State would cancell my CCW whenever the Black male was arrested again. We shared the same first and last name but had different middle name, race, physical description, Social Security Number, address, etc.

In Indiana License To Carry Handgun Permit (LCHP) was enough to get you a gun on the spot until about 10 yrs. ago. The State Police issues permits. Don't jump on me if I'm mistaken, but: I "think" that's around the time when the domestic violense thing showed up on the 4473. Since permits were issued then on a 4 yr. basis, in theory unless they pulled your permit you could become an abuser or felon between permit applications, and obtain a firearm illegally. So now a NICS check is required on all gun sales except person to person. Upon passing you take the gun same day. I don't put my SS# on 4473.
