Default Liability

I've read enough tales about cwp/le individuals getting sued for using their weapons to halt a crime. Some are really ridiculous, but some are judged in favor of the plaintiff. Should one carry liability insurance for just such a situation? Lawyers ain't cheap.

If you can find liability insurance and you can afford it, it is never a bad idea. Just remember that the companies may have some clauses as to what they cover you for. "Halting a crime" may be rather broad and some may feel that their permit gives then a licence to get involved. Liability insurance may be strained a bit to cover a policy holder for anything more involved than self defense.

I've been thinking about getting insurance. I've seen a couple of insurances but I'm thinking of the NRA recommendation mostly.

I've also read good things about Armed Citizens Legal Defense.

P.S. I would only use deadly force if my family or I were in imminent danger. I would be very, very hesitate to use force
in any other case. I would not say never but it would have to be an unusual circumstance.

I agree 100% with Walkin' trails, getting involved in stopping a crime could get someone killed. I am not getting involved to save some store a few bucks from a robbery. Now, if you have reason to believe and the average person would believe someone will be seriously injured or killed, that is a different story. Then you have to make sure of your target and what is behind it and what is behind you if he returns fire. Never an easy call.

My CHL instructor told us that if we shot somebody it was going to cost us at least $30 grand in legal.

Justified or not the guy's family will sue for wrongful death and tell the jury he was a Boy Scout, a Deacon in the Church and an all around upstanding citizen.

My CC instructor told the people in my class. Unless you are being physically threatened or a memeber family is being harmed, stay out of it. Your permit is for self defense carry, not police badge. Be the best witness possible.
Even the best insurance will demand a deductable, could be quite high.

I would say it depends on what State you live in. You can't make a blanket statement because self defense laws differ in each, Some protect the shooter in a legal shoot and some do not.

Probably the best advice I've heard yet. That, and avoiding providing first aid to a BG you just shot.

Might talk to your insurance guy or gal about an umbrella policy on top of auto and homeowner policies..at one time I had a $1,000,000 umbrella and not that expensive. The company did require that I increase the liability limits on those underlying policies.

You can do bazillion dollars worth of damage with a marshmallow and not every employer/agency may be stand up when you need them most.

I don't remember the link, but I read this last fall of a shooting in one of the southern states. It seems a young man 18-19 years old, out on bond for armed robbery, decided to rob a store and was leading the clerk thru the establishment with a gun to the clerk's head. A permit holder stepped up and capped Junior, saving the clerk. Junior wasn't killed, just wounded enough to be hospitalized. Was it the right action for the permit holder to take? I won't second guess him. Sounded like it was justified to me. However, it should come as no surprise that Junior's family was speaking out on Junior's behalf and looking for people to blame. I don't know what has happened since reading the article, but if the permit holder, who the local persecutors found to have acted in a lawful manner, gets any civil action against him, who is going to back him up. How many businesses, even if they don't display the 'no guns' sign are going to want to assume liability. I'm not suggesting not to do what is right, but be prepared for what may come in the aftermath.

Just defend yourself, and let others do the same. Lawyers are not your friend, and are expensive. Our CCW instructor told us to take care of you and your's. No movie cowboy. DW
