Default Ohio to Honor All + More. . . Long Guns in Vehicles. . . RBKA’s Orgs/Forums

Ohio Bill 234 was signed by the Governor today and goes into effect on March 19, 2015. On that date the following changes will take place in Ohio Law and I will add them to the Ohio page on that date. Ohio will honor all other states permit/licenses when visiting Ohio. They will issue non-resident permit/licenses to non-resident employed in Ohio. They have removed the wording that a semi auto that could fire 31 or more rounds without reloading as a machine gun and have gone with the federal definition of more than one round fired with one press of the trigger. An Ohio permit/license for those who move out of Ohio will remain valid until it expires. It can’t be renewed. CLEO must sign for NFA firearms if you pass background check. Active Military and their spouse have a grace period to renew if deployed out of state. There are other changes all for the better. Best thing is Colorado and Georgia will honor the Ohio permit right away. They honor everyone who honors them. TX, WI and PA have a good chance now of honoring Ohio. Texas for sure in the future and WI and PA most likely but not 100% sure. Time will tell on those three. You can view the bill by going here: http://www.legislature.state.oh.us/B...B_234_EN_N.pdf

Many news outlets are stating that Ohio will only honor some states. Here is the wording in the bill as signed by the governor.

Sec. 109.69 (3) If, on or after the effective date of this amendment, a person who is not a resident of this state has a valid concealed handgun license that was issued by another license-issuing state, regardless of whether the other license-issuing state has entered into a reciprocity agreement with the attorney general under division (A)(1) of this section, and the person is temporarily in this state, during the time that the person is temporarily in this state the license issued by the other license-issuing state shall be recognized in this state, shall be accepted and valid in this state, and grants the person the same right to carry a concealed handgun in this state as a person who was issued a concealed handgun license under section 2923.125 of the Revised Code. (I believe it is very clear they will honor all other states permit/licenses)

On December 7th I added the statute wording on how each state honors other states if they have such a statute. I put it in the first section “Permits/Licenses This State Honors.” Most are short but a couple that were very wordy were added to the Notes section of that states page with a note in the Permit/License section telling people to look in the Notes section.

Thank you for posting this. As a PA resident who has made quite a few trips to michigan, it always annoyed me that our neighboring state was a "no carry" zone. Now, if we could get Maryland on board...

This is great news! Now I have nothing to worry about when I make a planned trip to Indiana next year.

Now if Illinois would honor other States permits, specifically PA, I would be set. I'm not holding my breath though...

Glad to hear Ohio is relaxing some of it's regulations as Michigan did the same too after a few years of it's new CCW laws.
I do visit Ohio at times and did know their rule about having guns visible in a vehicle. I understood that has been revised too. Is that correct and guns can now be concealed in vehicles? Also can you carry in rest stops now? Last time I was in Ohio the bathrooms had signs forbidding it and a place I'd want to carry.

The next thing to fix is the definition that a loaded magazine/clip/speedloader equals a loaded firearm if there is an empty firearm in the vehicle that can accept it.

For example, an empty revolver + a loaded speedloader in separate compartments is defined as a loaded weapon and is illegal without a permit.

Does the CLEO signature for NFA items mean that a trust no longer bypasses him?

On NFA's in Ohio CLEO's could refuse to sign if they didn't feel like it. It made the "flower fund" a necessary contribution in some cities. When I got mine in 1982 I had to buy a state "Dangerous Ordinance Permit" for $50 per weapon to get Franklin County to sign, Columbus refused to sign for anyone. (by federal definition Dangerous Ordinance is over 50 cal, not NFA).Ivan

They changed their law that stated Loaded Mag in vehicle no matter where or how far it was separated form the firearm to the new wording below. It just has to be in a different compartment and that can be a different compartment in a hard sided case or any case that has separate compartments.

What Does OH Consider A Loaded Firearm?
2923.16 (K) (5)”Unloaded” Means Any of the Following:
(5)(a) "Unloaded" means with respect to a firearm other than a firearm described in division (K)(6) of this section, that no ammunition is in the firearm in question, no magazine or speed loader containing ammunition is inserted into the firearm in question and one of the following applies:
(i) There is no ammunition in a magazine or speed loader that is in the vehicle in question and that may be used with the firearm in question.
(ii) Any magazine or speed loader that contains ammunition and that may be used with the firearm in question is stored in a compartment within the vehicle in question that cannot be accessed without leaving the vehicle or is stored in a container that provides complete and separate enclosure.
(b) For the purposes of division (K)(5)(a)(ii) of this section, a "container that provides complete and separate enclosure" includes, but is not limited to, any of the following:
(i) A package, box, or case with multiple compartments, as long as the loaded magazine or speed loader and the firearm in question either are in separate compartments within the package, box, or case, or, if they are in the same compartment, the magazine or speed loader is contained within a separate enclosure in that compartment that does not contain the firearm and that closes using a snap, button, buckle, zipper, hook and loop closing mechanism, or other fastener that must be opened to access the contents or the firearm is contained within a separate enclosure of that nature in that compartment that does not contain the magazine or speed loader;
(ii) A pocket or other enclosure on the person of the person in question that closes using a snap, button, buckle, zipper, hook and loop closing mechanism, or other fastener that must be opened to access the contents.
(c) For the purposes of divisions (K)(5)(a) and (b) of this section, ammunition held in stripper-clips or in en-bloc clips is not considered ammunition that is loaded into a magazine or speed loader.
(7) "Unloaded" means, with respect to a firearm employing a percussion cap, flintlock, or other obsolete ignition system, when the weapon is uncapped or when the priming charge is removed from the pan.

Default "BULL PUCKEY"

I just received my notification, from Florida, that my CC permit will soon expire, for the third time. I just took it in to the Franklin County Sheriff's Department, in Columbus Ohio, to see what would have to be done, to renew this Florida CC permit. my problem is, that I no longer have finger prints. This Ohio department, in five years has gone from an office, being run by one office girl, to several offices with what appeared to be at least thirty employees. After at least thirty minutes of mass confusion, I was told that they didn't know what could be done about my problem. This problem was discovered by this same Law enforcement department, five years ago, while I was renewing the same permit. After this combination, "Goat Roping/Buzzard Stomp", and quite a sizable cash outlay, to Florida, including two eight hour school days, several other days spent, complying with Florida's wishes, several hundred rounds of ammo shot at their shooting range, earlier finger printing etc. I've had enough enough of of their insatiable thirst for revenue, and have decided, untill otherwise persuaded, to use the permit granted to me December, 15, 1791.

And a good thing too as Illinois isn't likely to change with all the yahoos we have in office ..

It would / will take a national law for Illinois and other states to change and that's unlikely to happen either ..

Since Federal Law now exempts LEO from signing for permission for NFA, how can a state now require it? And what “background check” because the federal background check done for NFA is not shared with a state.

Just check with a Class III dealer! Transfers are happening all the time. Senior Law Enforcement Official is now notified, but no signing required.

Second on Maryland. It's effectively a "no gun" zone as normal citizens can't even have a firearm with you, even if it's locked in the trunk.
