A city ordinance turns out to be a complete failure.

In California the constitution reserves gun control measures for the state legislature.

So local jurisdictions really can't make gun control laws.

A decade or two ago, San Francisco passed a ban on handguns. The Cal Supreme Court promptly struck it down.

Not sure if magazine limits would fall under this constitutional provision, but I'm sure that will be argued.

Do you really believe that Cal44? San Francisco has not only banned guns, but upheld this bad from parks in the city.

Could you please point to the section of the state constitution that says a local municipality can't enact and enforce gun control measures?

Yeah, the new mag ban will not result in anyone turning in any mags, but it will prevent us from using them.

OK, it isn't the constitution. It's state laws instead that give the state preemption of local authorities on most firearms regulation.

Here is an excerpt from the main preemption statute:

California Government Code § 53071 provides:

It is the intention of the Legislature to occupy the whole field of regulation of the registration or licensing of commercially manufactured firearms as encompassed by the provisions of the Penal Code, and such provisions shall be exclusive of all local regulations, relating to registration or licensing of commercially manufactured firearms, by any political subdivision … ..

Last I checked the SF magazine ordinance withstood court scrutiny, and the city of Sunnyvale also has a city ordinance restricting hi-cap magazines.

The first person to turn in their gun in S.f. was Mayor Feinstein who proudly turned in her Chief's Special .38. But the clerk at the S.F. Gun Exchange said he noticed she kept her evil semi auto Browning Hi-Power with the 14 shot magazine she says WE are too irresponsible to own.
