Hey guys, can anyone advise what is the amount of rounds that can be carried in a semi-automatic pistol in NYC..... Not quite sure if its seven and one in the chamber for a total of eight or ten and one in the chamber for a total of eleven.... please help......

I'm not sure, but I would think you could pull up the state website and find it there.

10 rounds.............the 7 round limit was shot down, so I think 10+1 is good.

This is the first i've heard of a limit on rounds in a semi auto.But I live in Kentucky.

You could always call an NYPD office and ask, just tell them you're an officer that will be visiting from out of state and want to make sure you're in compliance with the local laws.

10 plus 1...but from what I understand it has to be a 10 round magazine and not a larger capacity magazine with only 10 rounds loaded. It is based on individual magazine capacity not what you're carrying, at least...that's how I understand it.

...but it's a moot point anyway because generally NYC does not recognize a carry permit from anywhere else in the world. I'm not sure if there is an exemption for LEO or not. I would expect you'd still end up explaining it to a judge and never get your firearm back until you had spent 20X it's value in legal fees.

If you are retired from an agency in NYS and the firearm is/was your service gun or one authorized for use and is Hi Cap mag, you are good to go. If you are retire from out of state it's 10 round mags and one in the chamber = 11.

The last time I checked was the summer of 2016 and no state or city was below 10 rounds. One in the chamber was never mentioned just the rounds in the magazine. This is why I carry my Kimber Pro Carry Commander 1911 when traveling......but now I can carry my Smith and Wesson Model 1076 10mm as well. Hoorah.

LEOSA, known until its passage as HR218, and now correctly cited as either LEOSA or 18 USC 926(b) for active and (c) for retired, covers us anywhere, but we are still generally subject to silly state capacity laws. AFAIK, NYC does not recognize anything else, but they have no choice on this as federal law trumps their law as to carrying.

That's why my Glock 26 is almost always my carry pistol out of state, although since I got a 442 and a 642, I am liking them more and more for that purpose. At least I'll take the Glock and a revolver both along now . . .

I'm not sure I see where the OP actually said he/she was active or retired law enforcement...

It really is frustrating to live in the middle of the most restrictive city in one of the most restrictive states in the entire country. When friends and family have asked me, I usually say to just leave it home. It's not worth the trouble. I'm afraid for those of us who are not law enforcement Bloomberg and Cuomo won.

NYS can only carry 10 +1 in the pipe, You magazine must be a 10 round or less, can't have a 12 round mag with 10 in it, it is a no-no. Also retired LEO has the same restrictions. NYS and NYC law enforcement must sell or turn in their high cap mags. In NYPD I have some friends that told me it is a requirement before they will process you out. I moved out of NYC a long time ago after I retired, I miss the clowns but not the circus. I also miss the pizza.

Well, one of those categories of people would be the only ones really interested in conforming to the requirements of HR218, but it could just be for his/her general information . . .

I must have misunderstood LEOSA. I have a LEOSA permit, but I never travel. I thought it said you could carry nationwide but had to abide by all local laws. What if a local law said you could not carry?

Obviously it behooves us to know as much about the laws in the venue we may be visiting to avoid unpleasant surprises.

The only local law you are held to is the magazine restrictions. There are several fairly lively discussions about LEOSA on this forum. As everyone seems to be notoriously misinformed about LEOSA/HR218, it's not a bad idea to follow as many local restrictions as possible to save yourself an argument at the side of the road.

LEOSA would be as useless as female secondary characteristics on a bowling ball if it did not trump general state law carry restrictions. It was amended a few years ago (mostly) to overcome the misconduct in NJ about their restrictions about hollow points in public. There are some residual restrictions, of course. One should read it themselves and have a very good knowledge of what it requires and what it will not overcome.

The best source I have found is Cornell Law: 18 U.S. Code SS 926B - Carrying of concealed firearms by qualified law enforcement officers | US Law | LII / Legal Information Institute for active, and 18 U.S. Code SS 926C - Carrying of concealed firearms by qualified retired law enforcement officers | US Law | LII / Legal Information Institute for retired. Among other issues, you need to know what counts as an LE Officer; what counts as active or retired, etc. You should also have at least some idea of the state laws wherever you are going (we are probably required to notify if carrying when stopped in those states where that exists; don't get stopped, dummy). For example, here in WA, out of state officers get the same exceptions in-state officers do, which are broader than LEOSA in most regards. (I can remember when the thankfully former Chief in Seattle had a kitten about LEOSA, not knowing that State law was broader and that the stupid local SPD policies were not even lawful as to their own personnel, let alone out of state cops, due to being inconsistent with the statute.)(I do LE legal at work, and some private research, writing and teaching on it - the blatant ignorance of most command officers and lawyers is truly shameful.)

Because of bad drafting, it probably does not provide an exception to the Gun Free Schools zone law (the federal one), as that requires that the person carrying have a license from whatever state you are in.
