butts his way into a bad situation.

Two on one? Disparity of force has the effect of deadly force in most jurisdictions. In Florida and Illinois, one on one constitutes disparity if the victim is 65 years or older. Kicking in the head, with a shod foot or display (or feigning) of expertise in martial arts are others.

I think it was poor judgement to intervene unless blows were struck, and firing a warning shot is never justified. But you don't need a gun or knife to commit a felonious assault.

A little too quick on the draw. And, since he can legally open carry, his Second Amendment rights are not restricted.
He shot the ground. Maybe he percieved gravity was threatening him...

He's a TV cop wannabe with major ego problems. I prefer not to dwell on the apparent fact that he can still carry openly.

Intervening was unwise. Everything after that ranges from "illegal" to "impressively stupid". His inability to articulate himself is incredible. I'm amazed the jury didn't find for assault--he certainly testified himself there.

In case you guys are wondering, this is why having mandatory education requirements for CCW permits isn't necessarily a bad idea. There are a lot of Daniel Ray Browns out there. I've encountered a lot of them. Some are just well-meaning but ignorant of the law. Others are dangerously stupid--doesn't matter what the race or the age or the gender.

I'd sure be interested in seeing what the requirements are out there in Forsyth County--especially if there's a written test. You wouldn't believe how many people don't know what the "reasonable person" standard is.

I see a lot of things by looking at his photo but mostly how many more are there like him out there who only a few years ago were blissfully ignorant of guns until the video game wasn't making it anymore and the next stop was the LGS and then a C C class then a CCP and then "Huh Huh, ah R liceenzed 'Ta conceeled carry". I can't help but to believe there are 1000s like him out there who in a split second might do something similarly as stupid - with a possible worse outcome - and at the same time giving the seasoned, experienced gun owners a 'bad name'

While a complete doofus and a prime candidate for Diabetes that newspaper article had a VERY distinct bias. I also suspect that a trained police officer encountering the exact same situation would have either drawn his taser or firearm, because you just do NOT go "hands on" against 2 or more opponents.

So in some respects this Doofus did some things correctly. His first mistake was being too quick to draw his firearm, what he should have done was tell the 2 "attackers" that 911 had been called and the police were just 2 minutes away according to 911. His second mistake was firing a "warning shot", that is something that you never ever do.

I don't see "some" things right in the one thing he did that wasn't stupid and ill-advised -- unless you count firing into the ground instead of at any of the "perps". So, OK, two things right...

I agree! I would go so far as to say the judge and the author of the article both showed a very distinct liberal anti-gun bias. Ordering his gun to be destroyed was very unnecessary.

What was also ignored in the article was the fact that the "attendants" or whatever you want to call them did not help the situation. Someone is pointing a gun at me, I am going to stop and show them my ID and make sure they realize that I am not just dragging some guy off the street. Sadly, there is too much of that going on in the world and it can't just be ignored.

Nope - I have to disagree with you. The author, Sexton, is obviously biased, but the judge said nothing that any right thinking CCW person or instructor would say. Mr. Brown is his own worst enemy, the kind of guy who takes the class and gets by with a minimum passing grade, while thinking he knows better than the guy teaching him.

The misfortunate mental health are workers are lucky he didn't shoot them, so I will give him (Brown) that point. This is a classic situation where you don't know what you walked in on, just like a domestic violence case.

To the poster who thinks they should have stopped and shown their ID - have you ever been in a fight to control an insane or drugged up person?

Didn't think so.

I'd also add that it's the CCW holder's responsibility to ensure that his use of force is lawful and necessary--and not that of whoever the CCW is pointing a gun at.

Well, I'm no cop, but I suspect that a trained police officer would have first figured out what the situation was, before whipping out a lethal or less-lethal force option.

Especially given that, unless said mental health workers were stomping the patient's head on the pavement, I fail to see how there was a grave and immediate threat.

I don't get the part about him 'ordering' them to produce identification- a civilian has no right to ask anyone for anything unless it is part of his or her official duty. Sorry this guy is an idiot, did everything wrong as a CCP holder and was obviously playing out some twisted fantasy he had.

Wasn't there recently a police officer who shot at a hospital worker who was trying to recover a mental patient?
Wonder if he had his 2A rights revoked?
