In another forum I read about this guy in TN:

His defense was that Tennessee is an open carry state and he said he saw nothing wrong with exercising his 2nd Amendment rights.
What do you think of this?

Poor judgment, at best. Poor parenting for sure. Why would you be bored at your son's soccer game? Selfish.

If they were hosting a youth soccer game at a "Sportsman's Club & Shooting Range" then that is the only chance that this guy isn't a moronic idiot who only makes it tougher for the good guys.

This is the sort of thing that gives the rest of us a bad rap. I would say that doing this in a public place that is not defined as a shooting range would constitute brandishing. In my opinion, he displayed an incredible level of irresponsible handling and carrying of a firearm.

Not his best idea, but I really don't see much wrong. Would cause a little stir around here as well, but I wouldn't go so far to call him moronic or irresponsible. Ill advised, maybe . . .

I view the act as incredibly bad judgement. Open carry sometimes seems to be a privilege to be stupid.

much like the guys that like to walk around with an AR slung 'cause its legal... just 'cause its legal, don't make it smart. i will give him credit for realistic practice however! he got to deal with LEO after using his firearm.

I strongly support our 2nd Amendment, the NRA and the right of law abiding citizens to own as many guns as they can afford. However, I have reservations about open carry. The above situation is a prime example of stupidity, and a great example of how some one could be hurt or killed.

About the poorest judgment possible. If I had been the responding police officer I would have thought of some reason to arrest him and let a judge decide what he thinks about it. If it happened as described, that’s just ridiculous.

Your weapon is like your private parts, don't whip it out in public unless it's an emergency.

This is a bit like openly breast-feeding your infant in public. It doesn't hurt anyone, but a lot of people are offended and don't want to see it. But I don't think you should be arrested for it.

I like Fla's Breach OF Peace better but depending on known case law I'd be trying hard to make the Tn Disorderly Conduct stature work:

"(a) A person commits an offense who, in a public place and with intent to cause public annoyance or alarm:

(1) Engages in fighting or in violent or threatening behavior;

(2) Refuses to obey an official order to disperse issued to maintain public safety in dangerous proximity to a fire, hazard or other emergency;  or

(3) Creates a hazardous or physically offensive condition by any act that serves no legitimate purpose.

(b) A person also violates this section who makes unreasonable noise that prevents others from carrying on lawful activities.

(c) A violation of this section is a Class C misdemeanor."

Should one be able to do that without worrying about how others feel about it? Maybe. When I read the original post I just shook my head and thought "what an idiot". With as inflammatory of a subject as gun ownership, and more specifically, the right to carry is, why would "one of us" do something that would draw such negative attention and feedback? This is the type of UNNECESSARY behavior that makes us lose fence-sitters. What a worm.

Stupid on his part and in some locals he could have been charged with brandishing. He may have beat the charge, but why stir up the problem to begin with.

But here we actually may have consequences for stupid behavior, and we learn to accept the definitions of right and wrong that apply to playing in this sandbox. If we do not, we disappear.
Out in the real world, consequences for stupid behavior may / may not apply. So, people do not learn good behavior when it comes to playing with others. Nor do they get put away / disappear.
This site is a good case study for how to influence good behavior. My parents ran a household somewhat like this. It did no harm to anyone, but it did not promote or reward stupid behavior.

You know...I bet if the guy had walked a few yards into the woods , where he wouldn't be so easily observed, no one would have noticed.

It's like having to urinate, do it in public with folks watching and you will get in trouble.
Walk into the woods , stand behind a tree and there is no problem....

The worst part is this idiot makes the rest of us look bad. The media will run w/this story and paint all of us w/the same brush, using it as fodder for their gun control agenda. Thinking was never part of what this guy was doing.

I see and mostly agree with what just about everyone has said here though I don't think he's stupid, maybe just using poor judgement.

Having said that, allow me to play the other side for a moment and let's look at this from a different perspective...

The way I see this story, he moved away from the general spectator area to a place where people weren't. He then unloaded his gun and was practicing with an unloaded gun. Remember, it was dry firing and trigger control practice. Do you read something else?

If that's the case, and the muzzle was kept in the safest direction, what's the issue? Have the antis numbed us so much that we're doing their work for them?

If he was doing this in the stands, I would have an issue.
If he was waving a loaded gun around, I would have an issue.
If he was pointing it in the direction of other people, I would have an issue.
If he was threatening other people, I would have an issue.

Unless there's something I'm missing, he wasn't doing any of those things.

I long for the days when the mere sight of a gun didn't throw people into a panic, when the police weren't called just because someone had a gun in the vicinity, when you could carry a rifle in a gun rack in the back window of your truck and no one thought twice about it.


Yeah, I get it, you guys are concerned that he's making the gun community look bad. But isn't it really the general atmosphere, that guns are bad, that's making something that's really nothing look bad?

It seems just about anywhere in the US you can do something that is legal, but upset people because, regardless of legality, if they do not like it , therefore it must be bad/wrong/etc because only their opinion counts. I agree this man used very bad judgement. Unloaded gun? Did it have a sign on it saying unloaded or was the people in the stands watching just suppose to assume that? What do you think would people think if he took a soccer ball to a gun range and started kicking it around, I'd be a little concerned about his sanity. Should we be concerned what the anti's think, you bet we should! Their opinions impress just as ours do, this was not a favorable example of responsible gun ownership in my opinion.

I am in the just because you can doesn't mean you should camp. Did he do anything wrong. Yes, he mad a bunch of people uncomfortable for no real reason. I am a definite gun guy, second amendment guy, and if I saw something like that I would have to wonder what was up.

If I was in the lobby of the HS gym and some guy was practicing his karate moves, I would have to wonder about him to.

I live where there are pretty open views about guns. You see them and know they are around all the time. Nobody ever makes a big deal over it. Open carry is legal and you sometimes see it. In a couple weeks it will be big game season and it will be much more common and just as ignored. Our sheriff is pretty easy going and a "gun guy". You can even take your gun into the sheriff's office here. But, if I went down to the park by the soccer fields and started practicing my draw, I am sure him or a deputy would come talk to me even if no kids were around.

Some things are just poor form.

Boiled down to the essentials, this guy is saying:

"I sometimes practice my draw in public when kids and their parents are nearby."

Not much question about whether it's a good idea, IMHO.

Having said that, allow me to play the other side for a moment and let's look at this from a different perspective...

The way I see this story, he moved away from the general spectator area to a place where people weren't. He then unloaded his gun and was practicing with an unloaded gun. Remember, it was dry firing and trigger control practice. Do you read something else?

This has little to do with "open carry" or the "good old days".

It is about a guy in view of a crowd (including children) repeatedly whipping a gun in and out. I can't read minds so I would have to rely on the visual clues. The result being "danger, Will Robinson"!

I would hope everyone there went to DEFCON 1. I know I would.
