Default Arkansas Now Permitless Carry

Arkansas - On October 17, 2018 the Arkansas Appeals Court stated in case No. CR-18-353 Jamie Taff v. State of Arkansas: (“[I]n general merely possessing a handgun on your person . . . does not violate § 5-73-120(a) and may be done if it does not violate other laws or regulations.”). Under the clear language of section 5-73-120(a), the possessor of a handgun must have an unlawful intent to employ it as a weapon against a person in order to make that possession a criminal act.

5-73-120 was amended and passed as above in 2013. There has been uncertainty with people in authority (AG’s, Governors, Mayors, Police Chiefs etc.) saying the law didn’t and some stating it did allowed Permitless Carry. The above court case has finally settled that argument. Permitless Concealed and Open Carry is now legal for those who can legally possess a firearm! ...no, I think you were thinking about a time in Arkansas's past when there were all those "accidents".... People getting hit by trains and planes falling out of the sky...

Actually we have had constitutional carry since ACT 746 passed in 2013. It was complicated by a few in law enforcement (including the state police) who didn't want to accept the new legal standard placed into effect for charging someone with "carrying a weapon". A few arrests were made but in most cases charges were dismissed before trial or overturned by the circuit court in a non-binding decision. The Attorney General at the time Dustin McDaniel, rendered an opinion based on what I believe was a "softball set up" inquiry by a state senator that did not support constitutional carry. Our current Attorney General, Leslie Rutledge, eventually released a 15 page legal opinion that supported constitutional carry although (IMO) it could have been accomplished in one page in a much less convoluted manner. Our Governor, Asa Hutchinson, told our State Police to cease the improper application of the laws. Things have been pretty quiet since then. Since this ruling comes from the State Court of Appeals it establishes a binding precedent throughout the state.

Interesting but perhaps not surprising that the NRA-ILA page still lists Arkansas as requiring a permit.

At some point, a case will get before the Supreme Court. The decision will be interesting.
