Default Concealed Carry In New Jersey after Bruen update Sept 16

The following is not legal advice:

Most of us know that Bruen turned the six remaining "May Issue" states, into "Shall Issue" states.

In New Jersey, the process is going slow. There are apocryphal reports of some permits being issued in some counties. If such permits have indeed been issued they are few and far between.

In general, under New Jersey law, carry permit applications are first filed with the local police chief who has 60 days to approve or disapprove.

If denied by the local police chief the applicant has 30 days to request a hearing by the County Superior Court. According to the New Jersey Supreme Court a hearing must be held no later than 30 days after receipt of the permit to carry application, and the court shall make a determination within 14 days thereafter, absent extraordinary circumstances.

If approved by the local police chief, the application goes to County Superior Court to be given final approval or disapproval.

If not denied after 60 days by the local police chief the application is deemed approved by the local police chief and it goes to County Superior Court to be given final approval or disapproval

It is likely that the local chiefs of police and the County Superior Courts are experiencing a significant backlog in considering the flood of applications filed since the Bruen decision. In fact, it is said that the State Police are expecting 200,000 applications in the near term.

Please note, until the Bruen decision, the local police chiefs and the County Superior Courts were bound by New Jersey statute and Jersey caselaw to deny virtually every prior application and there were only 600 unrestricted carry permits in the entire state.

(Note: As stated by the Acting New Jersey Attorney General Here, except for the "Justifiable Need" requirement, all requirements of New Jersey law pertaining to the carrying of firearms remain in full force and effect. Anyone carrying without a permit should expect strict enforcement, relentless prosecution, no mercy from the courts and severe penalties if convicted.)

Sounds like a real nightmare there. Latest issue of Guns&Ammo has the states of N.Y. HI. N.J. CA. and Ma. as the 5 worse states for gun owners.

I can attest to NY. I’ve had unrestricted permit since 1991. I was at the pistol permit dept today adding my new Sig to my permit. The people who work there are fantastic!!!!!! Eager to help and very friendly. I hope they don’t catch to much slack because of our law makers. “IT” rolls downhill

Update 8/29/2022

One of the New Jersey Gun Forums is reporting the actual issuance of carry permits to ordinary citizens post-Bruen.

Unfortunately, there is no easy way for applicants to track the status of their applications in the Local Police Department or the Superior Court. This is important as there are statutory deadlines for appeals.

Update September 1, 2022

U.S. Post Office reports my money order was cashed. This is the signal we in New Jersey get that the Court is working on an application that was approved by the applicant’s local Police Chief.

Update September 16
Permits are being issued in many New Jersey counties.
Not one permit issued in my county
30 day deadline is 7 to 10 days away for my county to issue or deny my permit or hold a hearing.

Bushmaster1313 - Has NJ yet introduced any changes in carry / no carry locations like NY has? "Safe Zones", as it were...

Funny you should ask.

After Bruen our Dear Leader (the Governor) said that New Jersey was in a quandary because, since it had been impossible for ordinary citizens to get carry permits, there were virtually no laws on the books restricting where handguns were prohibited, and the legislature would need to take action. Since then some plastic banana feel good litigation was passed but in general it did not address the requirements to get a permit to carry or where permit holders could carry.

If you could believe it NJ is a freer gun state that NEwYohkistan. Before Braun we had more place to conceal carry than we do today. I’m sick. I have 3 years before I can retire. Waaaaaaaaa!!!

Believe it or not, for me, except for two things, the strict gun laws in the Peoples Republic of New Jerseystan rise to the level of nuisance but not infringement.

The first and most egregious infringement has been the statutory and court mandated scheme of not issuing carry permits to ordinary people. Even after Bruen. Some counties like mine are still dragging their feet and as of September 20, 2022 have not issued a single permit.

The second infringement is the de facto absolute ban on sound suppressors. My hearing is poor and sound suppressors, added to standard hearing protection, would go far in preserving my hearing.

All of the other myriad restrictions in New Jersey are for me but a nuisance. For example: a) I can wait 30 days between handgun transfers if I make a multiple purchase; b) I have no need for a bayonet lug or grenade launcher on my rifle; c) having to flash my FID card to purchase ammo is no big deal; and d) making it an enhanced crime to commit murder while wearing body armor is not something that crimps my style.

As people become more and more tolerant of gun laws they will soon not mind any laws. It’s the frog in in pot of warm water theory. Chip away slowly

some of the things that you want vs. some things you call a nuisance may not be what every gun owner is in agreement with. in NJ we have to be all in, this is the way the commies in trenton win by dividing us, for example i'll never be able to afford a .50 bmg or a fancy O/U shotgun but i support the people I can. I want to collect some M1 carbines and other military arms but because of the NJ evil feature BS I cant.
back in the early 80's I was a member of a range in Secaucus NJ , many of the old timers were perfectly content shooting their K-38's one shot at a time using a funny stance. I went one day with a 9MM 5904 I had back than and was shooting tactically and of course I got the speech about my style and why do I need a 15rd gun.

Update September 20, 2022

It has been reported that the judge who would normally sign off on carry applications has been replaced by two other judges. Don’t know if this is good or bad-but it is something.

In NC they’re coming from everywhere……. NY, NJ, IL, CT, MA, MI, CA, OH, PA,TX, MN, MD, and yes, FL.
