Default Be Careful in New Jersey

New Jersey Senate just passed the bill already passed by the Assembly to severely restrict concealed carry throughout the state. Big provisions include:

No carry in vehicle unless unloaded and locked in trunk or case;
Cannot carry on private property unless owner gives permission;
In 6 months must have carry insurance unavailable at present.

Even if unconstitutional the above will soon be the law unless and until a court overturns it

That has zero chance of surviving appeal, but the N.J legislature doesn't give a hoot, they just want to inconvenience as many gun owners as much as possible for as long as possible.

First it will go to an anti 2A District Judge who will delay as long as possible and uphold as much as possible. Then it will go to an anti 2A Third Circuit who will delay as much as possible and uphold as much as possible. Then it will be appealed to the Supreme Court and if the Supreme Court agrees to hear the case and if there are still 5 Justices who believe in the 2A it will likely be overturned for violating the Constitution.

In the meantime, get nabbed for violating these laws and no matter what you argue about the Constitution you will be in a world of hurt.

Same as NY. Already struck down most of it. The rest is about to get struck down…….. when it first passed I was surprised how many signs I saw permitting conceal carry on private property

I have grown to really hate that kind of garbage. Disarming honest people does nothing to make people safer, in fact it makes communities less safe. I know, I’m preaching to the choir...

Ohio took an interesting path.

Drug their feet for a long time and finally passed concealed carry, with a lot of restrictions.
* Required to notify (with lots of cases where police took liberties with the definition of "immediately")
* Could not carry concealed in your car (must be open)
* Lots of restrictions on where you could carry
* Almost every violation was a felony.

Now it's made its way to constitutional carry. I had my doubts it would ever happen.

There needs to be serious consequences for legislators who pass, and prosecutors and judges who pursue prosecution under and uphold clearly unconsitutional statutes.

Police officers can be held personally liable for violations of civil rights under USC 1983. It's time for the same to be extended to prosecutors, judges and legislatures.

I live in Ohio and have two Children and 5 grandkids in New Jersey and one +2 in PA. I still carry my permit for use in WVA, PA, and many other states. If I'm visiting NJ or Md, I usually don't take a gun along! It isn't right, but I have better things to do with my time, than be searched and interrogated for an afternoon!

However, in 17 years I have never spent a dollar in Md! One of the few things I have bought in NJ was a holster and ammo!

NJ is no longer a drive through state, but a drive around state.

After some thought, I can't think of a single reason to be in that part of the country.

When I drive South from Vermont, I swing West and take I-81. Avoid NYC, NJ, Washington DC, etc. It’s really sad because I was hoping to visit the USS New Jersey and The Air and Space Museum. We’ll see what I decide………

81 goes through MD for awhile, 12.08 miles to be specific, no respite there, and maybe worse.

To me, the definition of "careful" is to avoid places like that completely. Family gatherings can be arranged at a reasonable more or less central location. Example: I have one sibling near Little Rock, another near Buffalo, and one in Northern Indiana. As a rule, when we meet up - it is in Indiana.

I don't know why people are always so quick to say, "won't survive a court challenge!". These things almost always do. The vehicle restriction has been the law in CA for over 20 years and the other two laws have been enacted by municipalities.

I adopted that policy when my son and Daughter in Law moved from there to Alabama. When we drive to SC, we take a detour through upstate NY into PA, then south.

That was prior to Bruen. A lot of state restrictions are falling by the wayside, although it will take a couple of years to shake out.

Please stop.

We are talking about CCW. Nothing prevents carry in the car in CA for CCW holders.

CA has A LOT of issues. That isn't one of them.

When I was issued my permit, the deputy passed it to me with the words, "stay out of and away from schools, stay out of government buildings, stay out of New Jersey".

Heller lead to McDonald. There were intermediate victories along the way, including the case that resulted in IL starting to issue CCW permits.

I think some people are underestimating how huge a change Bruen is.

By eliminating "intermediate scrutiny" and requiring "text and history" from the time that the Constitution was ratified until the 14th Amendment was ratified changes what the lower courts can do.

Remember, that in McDonald, Justice Thomas wrote an opinion in which he concurred with the decision, but he disagreed with the reasoning. If he had had his way, the Privileges or Immunities clause in the 14th Amendment would have been resurrected and there would be no need to talk about reciprocity across state lines.

Reciprocity too will likely happen as a result of Bruen, but the road will be longer.

The Association of New Jersey Rifle and Pistol Clubs, who I believe to be an NRA affiliate (one reason to give to the NRA), immediately filed a lawsuit challenging almost all provisions of the new law. About 2 hours later the Second Amendment Foundation filed its own lawsuit challenging a subset of the provisions challenged in the first lawsuit. The first lawsuit was assigned to a Biden appointed judge and the second lawsuit went to a Bush 43 appointee. Not surprisingly, New Jersey filed an emergency motion to have both cases heard by the Biden appointee.

In the first case the plaintiffs promptly moved for a temporary restraining order and the judge ordered a fairly quick briefing schedule, with oral argument set for January 9.

Hang on to your hats boys and girls it’s going to be a bumpy ride.

The recent New Jersey anti carry law is getting hammered in the New Jersey Federal courts. For now, New Jersey is enjoined from enforcing the private property and vehicle restrictions. But that could change in a flash on an emergency appeal by the state.

Translation: “Hey Buster, the Supreme Court could not have been more clear — ordinary people have a right to carry a gun for self defense outside the home and NOTHING you can say or do will get me to interfere with that!”

A few weeks ago I received my NJ permit to carry ...and as of now I love it...the state is getting hammered in federal courts and in the end I feel this will be a wonderful outcome.

When you travel south on I-81 into Va. exit #313 (Winchester Va.) take Rt 50 east. Head about 25 miles to the Udvar Hazy Air and Space museum next to Dulles airport. Much nicer than the old Air and Space museum in DC. While in the area take Rt 5o another eight miles east to Waples Mill Rd and visit the NRA museum. You will be in Virginia the entire time

Just another reason not to travel to vacation in or spend a penny in NJ. I know that's not an option for many, but now that I'm retired, I'm very selective on my travel itineraries.

Stop in Wilmington, NC and visit the USS North Carolina. And you needed worried about getting mugged or arrested for having a firearm.

Was born and raised in New Jersey, and left in 1983 for better job opportunities and I never looked back. Have many relatives who have also woke up, and bailed...! Getting over run with liberals and always has been anti-gun as long as I can remember...NO THANK YOU !

China will take Taiwan, for sure. It's just a matter of time.

It's not about if, it's about when.

We are on the verge of WWIII. That could lead us to Armageddon.

Don't fool yourself into thinking that it won't escalate to the Continental USA. We have the best military in the world. But fighting on 3 fronts will be a challenge.

I just wonder if the unthinkable happens, will all the anti-2A politicians then start calling for a Well Regulated Militia?

I've often said one of the best things my parents ever did was move us out of NJ to go to Tucson when I was just a wee lad of 12 a mere 54 years ago LOL.
