That's because permit holders will be getting drunk and shooting each other in droves, right? I mean, that's what happened when we got the permit law passed.

I'm glad the bill passed. Those against it called it a guns in bars bill, but in reality, many nice restaurants do serve alcohol.

Previously, a TN HCP holder had to leave his firearm in his vehicle or at home if he intended to patronize certain restaurants, even if he did not intend to drink. That silly law didn't keep guns out of bars or any other establishment, except for those belonging to law abiding citizens. It accomplished nothing in terms of keeping any one safe.

The law in Tennessee remains the same in that it is unlawful to be in possession of a firearm while under the influence. Those who violate that law could find themselves in serious trouble, including revocation of their HCP if convicted. I am of the opinion that Tennessee HCP holders will continue to conduct themselves lawfully under the provisions of the new law.

Minnesota has allowed carry in liquor establishments since the passage of the "shall issue " law a few years ago. I haven't read of any problems with it. They also allow a person carring to have up to a .04 alcohol level before the alcohol level invalidates the permit. Most responsible carry permit instructors advise no alcohol when carrying in order to not make it easier for anti self defense prosecutors or civil liability attorneys.

The General Assembly passed a bill to do away with the stupid restaurant ban that makes it illegal to carry one's licensed handgun in any restaurant that serves alcohol. That puts one in the position of eating only at fast food places or going out unarmed or leaving your gun in the car unattended or risking getting a gun charge. Unfortunately, the jerk that is Governor now vetoed it and the GA didn't have the votes for an override. So, the stupidity continues in Virginia.

Georgia used to not allow you into any restaurant that served alcohol. However that has changed, they not put a income value on food vs. alcohol sales. As I was reading this I was curious whether or not TN would add such a clause. The GA code reads like this...

"(b) For the purpose of this Code section, "public gathering" shall include, but shall not be limited to, athletic or sporting events, churches or church functions, political rallies or functions, publicly owned or operated buildings, or establishments at which alcoholic beverages are sold for consumption on the premises and which derive less than 50 percent of their total annual gross food and beverage sales from the sale of prepared meals or food. Nothing in this Code section shall otherwise prohibit the carrying of a firearm in any other public place by a person licensed or permitted to carry such firearm by this part."

At least in VA you have the option of exposing your weapon, and going into Denny's, unlike many places that have this foolishness.

Arizona may pass a similar law soon. I know it passed through one of our houses.

But, no drinking allowed, you may be present with your weapon, you just can't drink.

You will not be able to drink alcohol in the restaurants in TN. But, TN already has a law where you cannot be under the influence of ANY alcohol while carrying your weapon.

Scoutsdad,
Tn has a food income/business level thing required under our Liq. by the Drink laws. We basically can not have "bars" other than ones that serve beer only. Only places to get a mixed drink or wine in TN by the glass is a rest. I think it is on a percentage of food buss. and it has to be over at least 50% of all sales coming from food. Besides around Jackson, I want to be carrying when I exit the place, for the trip to my car!

Bill 113 sponsored by State Senator Jack Harper (R-04), and House Bill 2171, sponsored by State Representative Frank Antenori (R-30), both allow a person who has a valid Right-to-Carry permit to carry a firearm into restaurants where alcohol may be served and is not otherwise prohibited by posting provisions. Though dealing with the same issue, these two bills are very different and the NRA will be watching them closely. During the 2005 legislative session, similar restaurant carry legislation passed through the Arizona State Legislature, only to be vetoed on the desk of former Governor Janet Napolitano (D).

This passed the State Senate, with a 50/50 food to drink amendment.

With a new Governor I think this bill will sail through.

Last October near here there was a police officer who had a gun discharge on its own. The gun just fired. He also had a blood alcohol level high enough to indicate a drinking problem.
