got a call from my attorney today with a offer from the condo attorney over my law suit over my flagpole. The offer was they will forget all the fines they say i owe, remove the lien on my property. if i will drop the law suit and keep my flagpole at 6feet my answer was
"FILL YOUR HANDS YOU SOB" DEDUKE |

If I were representing the HOA, this case would never get to a jury. I'd file a motion for summary judgment on the principle that there are no facts seriously in dispute, and the case is purely an application of law to fact. And a judge would probably not get distracted by the fact that your thing is the flag; the judge would probably limit the inquiry to whether the rules were violated and the fees legitmately imposed.
So you ought to make sure there are some facts in dispute. You are aware, right, that if they win, they can take your house and sell it in front of the courthouse to pay off the liens? |

for your info the hoa attorney did file for a summary judgement but like all the people involved for the last five years they have failed to read the state law, condo rules, and the DATES involved. after he filed his motion in july just maybe he read the dam case and realize that maybe he should try a out of court approached. around ohio it known that very few summaty judgement are granted by the judge DEDUKE |

I seem to remember some federal ruling that made TV reception antennas exempt from any HOA action. Maybe your flagpole should have a special "ornament" on top of it.

I've got a recording of that someplace. It came from my youngests slippers about 25 years ago. Just attach 3v and any movement sets it off. All it needs is an amplifer and they'd never discover the source! Settin' loose real live chickens sounds good.
