The Fugates were at the Nashville fairgrounds gunshow today.

They were buying every Smith revolver they could get their hands on at the asking price.

Do these guys know something we don't?

They know nice Smith & Wessons sell, and if you follow there auctions, they sell a lot of Smith & Wessons,no matter what what people think of there buisness practices.
I'm not defending them, just stating fact.

I've seen em around many shows and they are good buyers. Never known them to pay too much but they don't insult you with lowball offers either.

I see a lot of their auctions on Gun Broker, but I've never bought anything from them. They always have top-notch, table-grade Smiths, but they sell them at premium prices. (I've bid on a few, but quit when the reserve was obviously way higher than I could spend.) Not quite sure what to make of their business operation, but they've got some great handguns for sale.

DMark,

I have seen them at shows all over KY and TN.

They do not sell or set up tables, they only buy. It appears that they only sell on their own site or auction boards.

Interesting.

So they act like a private individual making a person to person sale.

Hmmmmm.... Roll Eyes

I wonder how that works with them being a dealer and crossing state lines - - - but not doing the sale as a FFL? How do they enter the buy into their records? Are they "dual citizens" of KY & TN?

This doesn't sound right.

They DO have an FFL, don't they? Does this not mean that they can go where they please and BUY not sell what they want? Am I missing something?

Also, The Dallas Arms Collectors Assoc., Inc. made a "cheat sheet" of rules for its shows. It is a good reference.

http://www.dallasarms.com/rules.htm

DEALERS LICENSED IN THIS STATE:

* MUST comply with all recordkeeping requirements of ATF regulations concerning accusition and disposition of firearms, especially recording the place of sale.
* MAY dispose of handguns to residents of this state only.
* MAY dispose of longguns to residents of any state, provided the laws of both states are complied with.
* MAY dispose of firearms to any Federal firearm licensee(FFL).
* MAY acquire firearms from any FFL licensed in this state, or from any non-licensed individual.
* CANNOT dispose of handguns to out of state residents.

DEALERS NOT LICENSED IN THIS STATE:

* MUST comply with all ATF recordkeeping requirements concerning acquistions of firearms.
* MAY acquire firearms from any FFL licensed in this state and from any non-licensed individual.
* CANNOT make sales of firearms with delivery, to anyone, even to or through an FFL licensed in this state.

Can display and take orders only.

NON-LICENSED RESIDENTS OF THIS STATE:

* MAY acquire long guns and handguns from FFLs licensed in this state.
* MAY dispose of firearms to any FFL.
* MAY acquire from and dispose of personal firearms to non-licensed residents of this state.

NON-LICENSED RESIDENTS FROM ANOTHER STATE:

My question is about the recordkeeping.

In Tennessee private firearm sales can be conducted between residents of the state with no recordkeeping.

Since the Fugates are residents of KY and a Dealer not licensed in Tennessee, what recordkeeper were they doing at the Nashville show?

If they acting like a private resident of Tennessee and weren't getting all of the seller's info for their out of state dealer acquistion recordkeeping then I would think that the ATF would be interested in their actions.

I may be wrong, and believe me I am not a Fugate cheerleader(just review my run-ins with John), but if they use their FFL then where's the issue? I do think they would use their FFL as opposed to private purchases, only makes sense. No NICS or background checks, just hand over a copy of FFL and walk away.

Pretty close Smiler

http://www.atf.gov/firearms/faq/faq2.htm#g4

TWO FFL dealers (different states ) may sell a firearm to each other at a gunshow BUT the firearm MUST be shipped from the sellers address TO the Buyers address.

" Smith & Wesson has to sell guns in all 50 states.. .. As long as we sell revolvers there will be a lock on them...."

AND I WON'T BUY THEM.
