Default Trespassers! The end! (I hope)

Well, for those of you that have been following this ongoing saga, we have some sort of resolution, of sorts. I went back to court today after yet another adjournment for this guy that has been caught trespassing and dumping on my property. Unfortunately, I trial did not look good because as I was told, and know well through my work, not many convictions come from the judge out that court. So, what we went wih is a full order of protection, which if he violates is a felony. The D.A. and I also put the idea into his head, which I am going to back up, is that there will be many cameras up, both real and fake. Which was passed on to this guy in court, as well as the fact that if he violates the order, the police, the local conservation officers, and the D.A. will all be called and there will be no deal, it will be a felony or nothing. This guy still wanted to fight the whole thing a bit, until HIS attorney told him, that he was on film, so he might want to clam up and take what was offered. Unfortunately I really don't think that this is the last I will see of this guy. Right now I am wondering how I could rig up an electronic game call with a tripwire and the sound of a 12 gauge pump being racked into battery.

Well, I guess the oop is better than nothing. I just have to wonder why the DA and judge didn't want to prosecute the guy. Seems like an open and shut case to me. I sure hope it's the end of your problems with him, but I have to agree with you. Until the guy has to serve some time in jail and pay some heavy fines, you haven't seen the end of him. I'd make sure you have some cameras up all around your house and anything of value on your property. It's a shame you have to go to these lengths to protect your own property from such an idiot.

David,

I hope this is acceptable for you. I still do not understand why the order of protection etc was tied to the not going to trial? As I said I would demand both as you are the victim in a CRIMINAL and not civil matter.


How the judge could override the clear video evidence etc is also beyond my comprehension. Even if the judge "threw out" the evidence etc it seems the protection order would hold...


I do imagine as ya said he won't be happy or educated enough until the felony comes about...


Hopefully you and or your family does not get hurt by this scum bag trespasser before they can get him.

Hi:
Low Lifes does not obey "Court Orders", they just get smarter at violating the law.
This guy will continue to "Use" your property until he is "Rewarded" with some "Hurt or Jail Time". The same is true of jealous former spouses or boyfriends/girlfriends. The Law is better now than in the past but still has a long way to go.

Stupid people do stupid things and they don't learn from experience the way normal people do. Not going to jail this time won't teach him that he was lucky and that he shouldn't press his luck. Instead, it will teach him that he's lucky, and that with all of that luck, he needs to see how much MORE he can get away with.

The guy I replaced at my last job was EXACTLY like this idiot. He didn't start stealing with us and he didn't stop stealing after he was fired. In fact, what little money he payed us toward the $30,000 settlement against him, he STOLE from his next sucker. I am absolutely CERTAIN he's stealing from somebody even as I type this. Psychopaths don't learn right from wrong. They learn to SIMULATE having learned right from wrong.

I'd be vigilant, maintain or increase the surveillance of your property and be prepared to defend yourself from him at any time.

An order of protection doesn't stop anybody from hurting you. It's the legally defensible way of saying, "I shot X because he did Y."

Wow! Look at the expense and time and trouble you have had to go through with this idiot. Makes me long for the good old days when a load of rock salt in his backside would have convinced him to stay the heck off your property. And you wouldn't have gotten into trouble for letting him have it, either.

sounds like the guy and the judge were family connected. carry at all times. you haven't seen the last of this idiot yet. i wouldn't walk out of the house without some kind of firearm slung over my shoulder,even to mow the yard.

judges dont like to have trials because if a settlement can be reached then every one wins.

We got a settlement for 10% of what the guy I replaced stole (that we know of). He stopped paying before we got 10% of THAT... most of which he stole from somebody else.

Judges don't like putting people in jail because it costs more than putting them in a Motel Six. Jail is expensive. Most criminals would be entirely happy to live on what it costs to incarcerate them, people on welfare get half that much or less.

They're discussing letting some 30,000 ? prisoners out in California for lack of funds, what does that do to the odds someone will get a slap on the wrist in ANY court?

We'd best figure out how to incarcerate less, and incarcerate some folks for Much Longer, and many folks get alternative sentencing. I'd hate to be on the receiving end of it, my impulse with trespassers is stay awake and armed and grouchy. But denying not that's a reasonable IMPULSE, at the bottom line we don't afford to lock up trespassers, and that's going to be moreso. There are places that burglary isn't even written up unless you insist, and gets filed in the trash. It gets worse before it gets better, but a homeowner who ignores the law will suffer enough disruption in his life he'll wish he'd acted otherwise. Even if you beat the case, if a firearms involved you're teetering on the edge of losing gun rights forever, all the guns you currently possess on the premises for an indefinite time, your parental rights terminated.. a LOT of stuff besides just convincing a juror.

But it must truly suck to be dragged through an ineffectual pretense of justice. I'm sorry.

yes the attorneys even though they got stiffed it still shows as a win on their court case record and not a lost

So far nothing, but the snow was pretty thick for a while. There were some atv tracks coming up to one barricade but they turned around and went back the way they came.

Aloha,

I have a friend who is a Judge. He wouldn't have put up with what you've gone thru. He doesn't give second chances to people like that. He knows better.

In one case, he had a 6" Smith 45 Colt sitting in a large manila envelope because the defandant said he was going to make trouble. The 2 court bailiffs were also the 2 best shooters in the system.

I don't think that guy would last long around here. I'm pretty sure that as many conservationists as there are around my neck of the woods somebody would start a food plot for coyotes.

For a few years I have believed that jail sentences for minor crime are counter-productive.

Instead, for non-injury DUIs, misdemeanors, and other non-violent offenses, we should bring back corporal punishment.

If this guy got 20 lashes each time he dumped, he would soon stop.
