Default Bank of America rant

My wife and I bought our home last June and ever since have had an ongoing war with Bank of America. They have on several occasions cashed our checks, but have not credited the account. I have had to mail and fax the same copies of cancelled checks over and over again. Last night I got our statement, saying that we were two months behind, which is funny because last month we were current according to that statement. I even have a letter sent to me back in April crediting the account as being fixed after they had to go through and fix the darn thing.
Well I called today and talked to three different people, and got three different answers. The first guy told me that it was the last two months that they did not have. Then the next girl said the account was screwed up since last year, which is what was in their own letter, supposedly fixed. The third girl, well she really had no idea where it was messed up she just knows it is. So I told her that I am going to fax every thing I have including copies of the cancelled checks again. (It was so bad that the last time we did this, I sent the school tax paperwork with the copied of the cancelled checks, they got the tax paperwork, but they lost the payment info).
Needless to say my blood pressure was quite high by now, so I asked the last girl if I could talk to the President of BAC. She replied that "he's not going to talk to you." So then I asked if I could have his name so I could write him letter. She refused, finally saying that she didn't know his name. Funny, it took me all of about two minutes on the company's website to find him and the corporate address. SO, while it might not do me much good, I am going to write this guy and at least give him a heads up (the girl told me to fax everything, well I intend to send everything to him, at least I can inconvenience his receptionist) and to tell him what I think of his company.

Bank Of America is a ***. They are the bank that were issuing credit cards to illegal! What does that tell you? Daaahh!

You might be best served by trying to get a mortage with someone else?

Might want to check your credit report to make sure they are not reporting you as late on the payments.
And remember this-paper trail paper trail paper trail. I have dealt with these circular muscles before and I can tell you it took me (as an attorney on behalf of a client) close to a year of letter writing to get the same type of problem addressed. ALWAYS get the full name or employee number of any person you talk to regarding the issue.
If you can show any type of economic loss( not aggravation) you can recover. Like for instance having to pay a higher interest rate cause your credit score was adversly affected by their actions.
Why are you dealing with B of A instead of a nice local bank or a credit union?? I always advise clients to use local whenever possible for this very reason (among others).

I think BoA got billions of taxpayer bail-out funds. You'd think they'd be able to afford to handle these problems. But maybe not.

many years ago, I had a similar problem with B of A credit card and got nowhwere with letters phone calls, etc. I sued them in small claims court for $1500 & costs( legal limit at that time) for harrassment,& damages to my credit, etc. No one showed up in court from the bank so I requested and got a default judgement and had the Marshall seize $1500, plus costs, from the vault at my local B of A branch. That got B of A's attention. The card acc't was straightened out immediately, I paid it off and cancelled the card and kept the $1500. Ed.

I've had B of A for 5 years.Very good IMO.Online,to the penny.I use Bill Pay,Auto.Dep.,Auto.Trans,Pay Pal,free Notary Public services,and have a credit card with no yearly fee[which i rarely use],all for free!All my banking is done thru them.My local bank has changed hands,and names,3 times in 7 years.

I quit bank of mehico when I went in to make a deposit and all the walls were covered with banners written in spanish. I closed my account on the spot, and told them I would deal with real American banks, not some bank that catered to the illegal market.

My experience pretty much mirrors yours. I guess it depends on the quality of people at your local branch.

I think you should consider doing the following ....
take all records of this to a different bank, preferably a local one and take a loan out to cover the BOA ballance.
since this bank will have seen the cluster imposed, this may make it easier to secure this loan and possible even get a better deal overall.

THEN pay off the BOA balance WITH a letter stating that they are now fired and why.

I deal with a few banks, BofA being one of them. They are about on par with the other banks in the area. With a minimum deposit they gave me a free safety deposit box. A good one too... not like my local First Tenn branch in Harrison which is more like a file cabinet. Everything is on line and works well. My banker is very accommodating and informed.

You won't get anywhere calling the 800 number.Go to your local branch in person with every letter they sent you.Sometimes this won't work either,usually it does.I've dealt with this before.If it doesn't work or you get tired of dealing with it it's time to get another bank.I did and couldn't be happier.My problem was with BOA also.

If they are reporting you as 60 days late with the credit bureaus, you won't be refinancing anytime soon. You need to contact their servicing department and escalate the issue. As Cajun said, keep detailed notes on who you spoke with and what they said. Get employee ID #'s.

3 years ago I bought my home. In the first month my mortgage was sold 3 times. By the end of the first year twice more. BoA was the final settling place. Since then 4 houses in my subdivision have been foreclosed on and we have had 3 short sales. My home value has plummeted thru the basement into the bowls of the netherworld... All the while BoA has been doing the same **** to me. All that being said to make this statement. If you can get refinanced right now you are one fortunate s.o.b. because even if I had a perfect score they won't refinance a house that is worth $40k less than the mortgage amount.

Our local branch is fine. they are always helpful and correct. In fact I have quit mailing in my payments and take them directly to the branch. Since then everything is OK.

But Cajunlawyer is 100% dead on. Paper trail paper trail paper trail... Just view it as necessary scouting. You are compiling evidence.

My recommendation though is this. Go to the local branch and pay your mortgage if that is an option for you.

Using the 800 numbers I got a host of excuses.things like sick today,transfered and my all time favorite,Shes on maternity leave.Even the supervisors suffered these elements.Every thing needs to be on paper or the problem is gonna come back.I have a huge file from their stupid and inept and various departments.It don't seem as though one hand knows what the other is doing.

put all the info you have on a big placard and walk in front of the bank.write to the editor of your local paper, call the tv station.get the branch managers address and go see him at home, tell him you found his info, he can fix your problem.and be lookin to refinance.

Call your local news station consumer rights reporter. Maybe that will help.

I had BofA for many years. After several years of the same old stupid mistakes at different branches, I quit them and went to US Bank. No more problems.

In 15 years with BOA I've only had a problem with them once when they mirrored a debit thus overdrawing my account resulting in a lot of OD fees. Customer service was useless but what can you expect when they use a third party company to handle their CS. I walked into a branch office and asked to see the manager. He came out and told me they don't handle CS issues in the banking center. I told him they needed to handle this one because I'd been fighting with CS for two weeks. Ten minutes later it was all straightened out.

I'm with the group that have had no problem. It depends on your local staff. Mine are great. I have three checking accounts there, my own, a Friends of NRA, and our local Pistol Club's. All at no charge. My debit card and my VISA card are Bank America. When I sold my house, and was building a Condo, I put the proceeds of my home sale in short term investments, and when it came time to write a check for the Condo, I was like $50,000 shy of enough to cover it without an early cash out of my investment. I couldn't get a Home Equity credit line as I didn't own the house yet. So my bank told me to just write the check, they would watch and approve, then when I had the Condo in my name I could go in and get the credit line, which I did about two weeks later. They carried my $50,000 overdraft for that two weeks at no charge.

When we went to Italy a couple years ago, our banker told me to be sure to use Deutche (? SP) bank as they were affiliated. I used their ATM's and was assessed only a 1% rather than a 3% fee which is customary. I was also only assessed a 1% fee on my VISA card purchases. I've banked at the same "building" for 40 years, it has had 3 different owners with Bank of America being the owner for about the last 15 years.

I have nothing bad to say about them. It's all in who the staff members are.

I agree. And personal relationships are very helpful too. Two customers with the same issue at the same bank can have much different experiences.

Going forward have all of your accounts (savings, checking etc) as "online accounts" and view them daily if possible or atleast 2 times a week. By the time your "difficult to read" monthly statement is reviewed by you its too late!
