California’s Mail Order Ammo Ban
California’s Mail Order Ammo Ban ‘AB962’ goes into effect February 1, 2011. This bill states that all handgun ammo sales in California will require a face-to-face transaction between buyer and seller, and that sellers must obtain a thumbprint, do a background check and obtain ID from the buyer. This bill also prevents California ammunition-makers and California ammo sellers from selling their products to customers outside the state. It also includes all rifle ammo that can be used in a handgun.
AB962 was originally conceived to cut down on crime and gang violence but the bill also punishes law-abiding citizens and interferes with and restricts legitimate business in California. AB962 is currently being challenged in the California courts under the Commerce Clause of the U.S. Constitution that states Congress has been given authority to regulate interstate commerce.
No, I do not live in California but there is that old saying, “So goes California, so goes the nation.”

KG - I guess it is possible that the Feds might pick up on this and it becomes a concern for all states. However I think the fine people of Texas view California as a separate country. I find it hard to envision Texas going along with anything that California does.

I bet you'll start seeing a lot of Cali guns on the net auctions next year. That or once people realize this bill also applies to the ever present 22 LR the law may get changed.

ANY caliber "can" be used in a handgun!
Do they have a list of affected calibers, or do you find out if your a felon AFTER they charge you!?
I won't ship any gun to CA, whether its on the list or not.
Not to LE either, they shouldnt get special preference for personal purchases if a "citizen" cant buy it.
No one ship anything to CA, no more guns, and I'm sure their crime problem will go away in a couple of months.
I have family in CA, who shoot and own guns, but don't vote that way.
They don't deserve the right to complain in my book though.

Both dems and repubs realize being anti-gun and getting elected (reelected) don't happen in Florida. Except in Miami which technically is its' own country. Joe

I hope that the NRA is workng for the repeal of this law. It is pretty obivious that this law was intended for more than reducing gang violence.

Our Governor Kennedy, I mean Shwartzneggar, let this happen after years of showing us all how fun it is to blow people away by the dozens in all his movies. I was just so hillarious, wasn't it, seeing him say, "Aheel be baaack." before killing all those police officers in The Terminator. Boy, that's entertainment! But he has nothing to worry about. He's surrounded constantly by law enforcement officers now. He gets rich pretending to murder them in the movies and now they protect his butt in real life.
How does that Animals song go. "I gotta get outa this place, if it's the last thing I EVER do."

im so glad our state that is 20 billion ( on paper haha) in the hole this year and no budget in sight has time to chase nonsense as this.

As I recall it, the bill defined all sorts of things as "ammunition" to include moon clips.
ETA: Here's the relevant text...
Quote:
(c) For purposes of this section, "ammunition" shall include, but
not be limited to, any bullet, cartridge, magazine, clip, speed
loader, autoloader, or projectile capable of being fired from a
firearm with deadly consequence. "Ammunition" does not include blanks
used in prop weapons.
SEC. 6. Section 12318 is added to the Penal Code, to read:
12318. (a) Commencing July 1, 2010, the sale or other transfer of
ownership of handgun ammunition may only occur in a face-to-face
transaction with the seller or transferor being provided bona fide
evidence of identity from the purchaser or other transferee. A
violation of this section is a misdemeanor.
|
No mail order bullets, magazines or moons. Love the "shall include, but not be limited to" clause. Maybe next week they'll add cars being driven to sporting goods stores as "ammunition."
But hey, the weather is really nice...

I like it!!!
I would suggest that this law runs afoul of the Commerce Clause of the US Constitution and would think that once it takes effect a challenge on those grounds, as well as othes will be forthcoming.

Again I say to **** like this you had better have plenty of powder and primers, wheelweights and moulds for a rifle and all your revolver and pistol calibers on hand to roll your own. Jeff

This new law really presents a golden opportunity.
This new California law may well be a pain in the butt, but come-on gentlemen you are missing the great opportunity this presents. A chance to spend a fun filled weekend in Reno/Sparks, NV.
Here is the plan. Leave work on Friday by 3:00 P.M. check into the Reno Harras hotel by 7:00 P. have a drink and a nice dinner. Saturday morning out to Sparks to pick up all the ammo you can afford. Saturday afternoon, back to Harras have a sauna and a massage in the members club, and then play a little blackjack. Saturday evening dinner and a show, then get a few bets down. Sunday have a decent brunch and head for home.

Having a bit of trouble finding 22LR primed brass. 22LR reloading dies are pretty scarce too.

This was never meant to reduce crime, and just how many single shot hunting pistols have ever been used to commit a crime?
