OK, you lawmen, how is this for a Texas happening? (Some might argue that Austin isn't in Texas!)

I can understand the PI charge but DWI? And saying that a mule fits the legal standard for a "motor vehicle"?

I once saw a guy charged with leaving the scene of an accident while riding a horse. He was drunk, "borrowed" the horse, and rode it into the side of a car that was stopped at a stop sign. Case was dismissed because a horse isn't a "device" as is necessary to fit within the definition of "vehicle" under the traffic code. Still don't know why they didn't just charge criminal damage.

Im thinking Law enforcement isnt taught the spirit of OWI law.
its sole function is to reduce the number of pickup trucks ramming into bus loads of kids and similar incidents.
the car or truck cant think for itself, thus absolutely relies upon the operators judgment.
A horse ... well it has something a car dont ... a brain and it seems pretty well programmed in the interest of "vehicle" survival.

Texas should be ashamed of itself. Too many city slicker cops they've pinned a badge on, trying to make new law.

There was an old case someplace where the outcome centered on a sober horse has more sense than any cowboy, so riding one isn't DWI. The horse is in charge.

We have stupid laws here in Kentucky. We've convicted folks of DWI for sitting in a pickup truck drinking beer and watching a river flow by. Also for cutting the grass whilst drinking a cold one. Its just taking the law way too far. But the judges protected their own turf. Drinking beer while riding in a golf cart was found to not be DWI. Go figure. Judges, lawyers and other scoundrels play golf, so its OK.

I can't comment on riding mules. I've never done it, but I've seen a few that will flat fly. Racing mules?

More than one critter has gotten its owner home more assuredly than the owner could otherwise. He should be proud to own such a steed.

If I'm not mistaken I have heard of drunks getting dui's at mule day in Benson, NC. when I was younger. But I don't see the diffence in a horse and a lawn mower with a drunk on it. I might be inclinded to swerve to avoid a collision with a lawn mower and a drunk. Which in it self would put me and mine in harms way. Doeboy

A mule probably has more sense than a sober cowboy. You see horses with wire cuts and scabs from goin' where they shouldn't, but you don't never see no mule in that condition.

Off topic but my best mule story is in Buffalo Bill's auto biography. Seems he was riding at night to avoid hostile indians to deliver an urgent message to a remote fort. He favored mules becuase they had more endurance than a horse. At some point he relaized there was Indians on the trail behind him but they didn't know he was ahead of them. He was going as fast as he could while not making any noise when the mule threw him. The mule would run about a hundred yards ahead until Buffola Bill got within grabbing distance and then he would take off and run another hundred yards. This went on for about 8 miles, mule ahead, Buffola Bill getting madder and madder, hostiles following unaware. Bill worried that at sunrise the hostiles would see him afoot (they were on horses) and he'd be a dead man.

Just before sunrise he spotted the fort and took off at a run. So did the mule. So did the hostiles. Mule got to the fort first. Bill got there second.

He shot the mule then ran inside.

The last (and only) mule I rode had more gas in it than my car does right now.
