Default ? about picking up new gun!

I ordered new moss 590A1 6 weeks ago from dealer said it would be 7-10 days ,they are normally good place to go . Now my problem is I just got knee replacement and cant go get it my self. They said I had to and that I couldnt have my wife or sonlaw pickup. Is this right I didnt think it pertained to shotguns. Any one know Ohio law on this? Thank You

I'm not up on Ohio law, but I would make sure you don't have a fight with either of them before they head out to get it.

YOU have to fill out the paperwork for the gun YOU buy. Anything else is a straw purchase.
Guess you will have to wait a little longer.

I do not know Ohio law but here in Florida if you did not start any paperwork and they just ordered a gun, your wife or anyone can go buy it as long as they pass the background and are a resident and all that.

Did you allready complete a 4473 and pay for it? If so then yes, you have to get it.

If you have put money down on the gun and not filled out a 4473 you have started the purchase process and anyone else filling out the 4473 would constitute a straw purchase. Ten years in the federal prison and a $250,000.00 fine are reason enough that I would just wait until I was back on my feet and was able to go fill out the 4473.

See if they will let you put it on lay a way and pay for it. That way they get their money and it is yours when you go pick it up and fill out the 4473.

Re OCD1's post, technically, it might not be a straw purchase, but I think that would be walking the edge. The first question on the 4473 is, "Are you the real purchaser of this firearm?", or words to that effect. Since YOU are the real purchaser, if your wife or friend says "No", they can't have the gun, and if they say "Yes", they are committing perjury.

I know that, if I had a gun store, and I ordered a gun for Joe Blow (whether he paid anything down on it or not), and when it came in I called Joe and told him his gun was here, and someone NOT JOE came in and said they were here to pick up the gun for Joe, there ain't no way I'd let 'em have it. That just looks waaaaay too much like a ATF sting, to me.

I wouldnt bother pointing out a error to them. People dont like it and will stick to their point. You are laid up and cant use it yet anyway. Just call them up, tell em your laid up and will get there when you get there.
If they argue say you will send the wife. If they still argue tell them to send you back your down payment that she will pick up and you just will go to his competiter. No big deal.
