Default Bad checks?

My wife's employer has a habit of giving her useless checks.We quit trying to deposit them in our account and opted to use the check cashing store.This after the grocery wouldn't accept them anymore.We have to pay a percent of her check to cash them at these places or even his bank.
We have one now for 60 bucks and are afraid to try after the last one bounced at the check cashing store.They don't want to see his checks again even after he straightened that out.
She quit her job yesterday for other reasons that are even worse.
What to do with this useless check and even more useless employer?

If they won't start paying in cash then it's time for job hunting. Actually it sounds like it's time for job hunting anyways. I'm sure at some point he is going to be guilty of something like check fraud if he isn't already. I wouldn't want to get dragged into that.

If it's not terribly inconvenient to visit the bank that the check is written I would do that. When I was a kid I had a part time employer that was similar. He wasn't trying to be a thief, it's just that his cash flow was horrible. I would visit his bank one day and would be told no, but then a day or two later the bank would cash it.

First, the only place I would attempt to cash it would be HIS bank if it is local of coarse. I would have his bank stamp in insuffciant funds and then I would call him and tell him to meet you with cash or else you are calling the Sheriff and charging him with check fraud. You can also sue him in small claims court for 3 times the face value of the check plus any fee's that you incurred as a result of the bad check.

Time for a little investigating, and maybe a Set Down.

Years ago, my wife worked for a Armed Security outfit that had a contract with a ANG Base.

At the time I had a small business of training and certifying private armed security in weapons training. My wife's outfit was one of my customers. With the records of their armed guard, they had to have on hand a copy of my instructors certication. No biggy.

Until my wife's pay check bounced. I wasn't happy, I had a set down. We disided if any more of her checks bounced, things were going to get real western.

Well the next check bounced. I got nasty and did an audit on their training books. I dug and pried until I found something. Turns out someone was using my certification to say I qualified people I didn't. There were a few other "out of the norm defects".

I pushed and pried and when I got through, the security outfit lost their contract, owner went to jail. My wife got another job who paid her with good checks.

I will not have someone mess with my wife under any circumstances.

I'm gonna try it one more time at his bank today and if there's any problems they are have to take it out of his behind too include their blinking check cashing fee.

The job hunting has been going on for a while.His business has been going down for some time due to his own actions.I think he's on dope.

Simple thing to resolve. Go to the DA's office and file a complaint with the hot check division. They'll get your money or the guy goes to jail. You pay something like $15, which they get back from the guy, they send a 10 day letter and then file charges. Me, I'd much rather do it this way than beg plead and cajole his bank not to charge you for cashing it.

DG, I don't know what the limit is in FLA for when a bad check goes from being a misdemeanor to being a felony. Look into it and see if the check is over the misdemeanor limit. You would be suprised at how low some of felony limits are set as most of the laws governing bad paper were written years ago.

A side note: I had a customer that just simply would not pay the invoice I sent him. I put a lien on his house and it showed up on his credit report , he was po'd. I ended up having to take him to civil court and won a judgement against him for the near $14,000.00 he owed my company plus attorney fees and court fileing fees. Total judgement was close to $22,000.00. The check he wrote to cover the judgement bounced. We had him arrested at the hospital where the good doctor worked . If he had simply refused to pay the judgement all I could have done was take him back to court. When he wrote a bad check, everything changed.

DG,

I handle what little collection activity we have, for my employer.

When I have to make a personal visit regarding a past due account, I RARELY will leave without a check, as it's one of the strongest inducements for payment in Indiana.

Check bounces and it goes straight to the local prosecutors office and they file charges.

Those with a history of passing bad checks have probably already been jailed and are not eager to have it happen again.

Just a last minute thought before I shutdown for the evening:

I was out of work for a while and getting sub $10 an hour job offers at best for months once I got out of the USN. I finally went to the local Workforce office office. They helped me unfudge my resume, give me tips on what to say in interviews, and one week later I was in an interview at Home Depot as a Pro Sales Associate. It wasn't awesome pay but it paid the bills, it was working in A/C around great people, and the benefits they offer were pretty decent. A part of me wishes I still had that job and hadn't become a civil servant. But I wanted my military time to still count for something in a retirement and ( i guess...) it was the right thing to do... Even if it is a stretch of a drive it should be worth it. And the best part - It's FREE...

All went well today and the check cleared.

We will wash our hands from this guy now.He won't be in biz much longer with his current practices.

My wifes issue is "Why the sudden change in his attitude?"The business could be very good but some influence has changed everything.

She better get a job soon.

She has always been in the bar and food service industry.Her Pops had restaurant in Nurnberg Germany that she grew up in.Lots of places around here but nobody so far is hiring.It's slow now and our "season" was bad last year.

My life has been flushed down the toilet more than once when I unknowingly began working for a thief.
At least after long experience I have learned the danger signs.
Because of this, as a freelancer, I no longer sign on to work for one agency. It's first come, first served. I don't make a pile of money, but I don't get on the hook for hundreds of ours of sweat and nothing to show for it.
Bouncing checks will get my attention even faster than pretty young women walking down the sidewalk.
(I did try to form a reporter's union. Couldn't get anyone to go along with it. Since I was in Golden at the time, I came up with The Honorable Union of Golden Stenographers. NSL.)

I don't take checks anymore, unless I know the person and know they are good. I had a guy in New York bounce a $500 deposit check off of me, and the bank charged me a fee for his bad check. I don't know who is the worse crook, the bad check writer or the bank!
