I do love it, but I think that that bank should pay a penalty for making the folks go through all that -maybe 5 times the legal fees.

Since WaMu folded it's tent, BoA has been one of the worst. I tagged them for a couple of grand in atty fees a few years back for stupid stuff like that.

It's good to hear they got compensated. I think these mistakes are a byproduct of banks being allowed to get too big. The left hand doesn't know what the right hand is doing.

California EDD is now making it's UI payments through an ATM card at....you guessed it... B of A.

One of my jobs as a LEO is to enforce the foreclosure order. It starts when a homeowner gets several payments behind. I will deliver a court summons to the homeowner telling them to be in court to address the arrearage. Some show, some don't. The next step, after the home has been sold at auction on the courthouse steps, is a summons to court to show why they are in possession of someone else's home. Again, some show, some don't. The final step is a writ of possession ordering me to seize the home and evict the occupants whoever they are. Sometimes the occupants are not the mortgage holder. The homeowner has an opportunity at the first two steps in this process to make arrangements to adjust payments or get caught up on back payments. Some do, some don't, and for various reasons some can't.

When I get a writ of possession I go to the house to see what the situation is. Most of the time the house is vacant and I call the bank and they send a realtor and a clean-up crew. Whenever a house is still occupied I talk with the occupants and tell them they have to move and find out how long it will take them to get out. I want them to move on their own. If they don't move the bank sends a moving crew out that I have to supervise. This can sometimes take several days, which is one reason I want them to move on their own. The writ of possession orders them to move immediately. That ain't gonna happen on my watch. I give them enough time (usually 30-60 days) to make an orderly move. The other alternative is to move their possessions to the side of the street. I've only had to do this twice in the last five years. Very often while waiting for someone to move I start getting calls from someone representing the bank wanting to know why it is taking so long. I quit trying to explain it to them and tell them if they don't like the way I'm doing it to come do it themselves.

I'm working one now involving a disabled woman. Her husband left her and her kids are grown and gone. She has a government assisted apartment she wants to move to but had no one to help her move. No way am I going to "throw her out on the street." Her church wouldn't help her so I got some volunteer firemen to help her. I haven't been able to check her house since Thursday, but I think she will be gone when I go out there tomorrow. The woman handling this one for the bank called me several times about it in the last couple of weeks. I called her back and got an answering machine and left a message last Monday. I'm glad I'm in the last quarter of my life because I don't want to see the coming revolution against the government and the big corporations, especially the financial industry. I love my country and fear my government. The Federal government has spent this country into poverty. Corporations have shipped as many jobs overseas as they can. The midde class was the safety net and it's gone. The poor like the woman mentioned above is just discarded and there is no safety net for her or anyone like her but we have plenty of money to give to foreign countries like Pakistan (9.8 billion last year). The law enforcement community always states "I'm just doing my job"
The job was "to Serve and Protect". The "who" is the part that got lost. The Sheriff in Wayne County Michigan refused to remove people on a forclosure order until the bank could prove to him and in writing all facts were documented. The bank hauled him into court and the court was going to find him in contempt until he read them his oath and the subsequent law.
His statement to the press was something like " When I took office I promised to serve, protect and defend the constitution of the United States, the State of Michigan and the County of Wayne and it's people. It doesn't say anything about multi-national corporations or banks.That's what I'm doing - protecting the people of Wayne County - that's what we are all suppose to do - protect all of our people especially the weakest who can not protect themselves, and I intend in doing just that.The people of Wayne County elected me - if I'm not right they can unelect me."

I think he's on to something.

Many months ago I received a credit card statement from MBNA in the UK. The first thing I noticed was one essential element had been removed from my address, namely the country I live in, France. Someone, presumably the UK post office, had obviously recognised that it was a French address and had written France on the envelope.

I phoned MBNA and, after a delay, was told that my bank had notified them of a change of address. In fact my address had not changed at all. I was furious, and immediately phoned my bank. They said they hadn't notified MBNA of any change, in fact they would never do so. So MBNA had lied to me. I filed a formal complaint with MBNA who shrugged it off as incorrect information given to me over the phone. That was not good enough for me. I persisted with my complaint and followed the complaints procedure to its conclusion. They refused to compensate me for the inconvenience they had caused me. The Vice President of MBNA wrote to me and even denied that they had changed my address. A further lie, this time from the top.

Having got nowhere with their internal complaints procedure I complained to an external organisation, the UK Banking Ombudsman. After many months they finally upheld my complaint and ordered MBNA to pay me £100 compensation. It is a pityful sum considering the amount of time and the number of letters, but at least I established that they were wrong and had to pay compensation.

Who owns MBNA. You guessed. Bank of America.

If anyone out there can tell me the address of the corporate HQ of BOA and the name of their chief executive I would be greatly obliged, as I would like to write to him to tell him the full story to show how their subsidiary company lies to customers.

Sip, You have made my day.

For the past ten years I have used a BANK OF AMERICA credit card. During this period, I have always paid the full amount at the end of the billing cycle. Not one penny of interest has been paid

Last month I called to try to locate the check I mailed to them, conversation went on for about 2 weeks, they couldn't locate the payment. I then put a stop payment on the so called check and rewrote a new one which included more of a payment, as I had two more entries which took place.

Next thing I look at my account and guess what, both checks appear, they now owe me money.

I of course call them for the 5th time and have to go over everything from square one, not too happy.

I then look at my account, they remove the first check, and attempt to charge me a $15.00 service charge for putting a stop on the check, even though they have possession of my second check.

Call number 6, once again go to square one, blah blah blah.
Finally everything is cleared up, and I told them to cancel the credit card. Trying to be nice with my words but you guys don't need me to spell it out

Find a nice small credit union or local bank, definitely stay away from BANK OF AMERICA It is really a sin for them to use that as their name.

Bank of America is the next Enron. I had them as my bank for six months and got rid of them asap for a number of various errors that I spent some time on getting corrected.

First score one for the little guy’s, homeowners; it’s lucky that they had the resources to follow up on this. Sadly though one small incident like this will not change the way B of A or any other large bank does business. There is too much money at stake for the bank, and they know that most people will get discouraged and go away.

I’m old enough to remember when your community banker was someone who was respected and looked up to as a member of the community, not so today and all of us are a little worse off for that.

BANK WITH A LOCAL BANK. I preach this mantra every day. You want to bank with a bank that you can go in and sit down with the guy who is going to lend you money. Period.
As far as credit cards go, they are a necessary evil. Use them not as the banks want-pay them off every month. Keep your records-what with scanners there is no reason not to. Phone complaints will NOT preserve your rights. Written Communication sent by snail mail is best. Don't worry about the expense of certified; mail it first class, there is a presumption in the law the they got it. Write down the name and ID # of anyone you talk to. Remember you can always go to a supervisor. There is also no reason not to familiarize yourseld with the Federal rules and regulations as everything is on the net. And don't forget that most of these rules provide for attorney fees it you are successful. There are legions of consumer lawyers out there that make a handsome living suing these banks for screw ups such as these. Customer gets his account fixed, gets a couple of hundred dollars (or more) as stipulated damages, and the lawyer gets his fee. Pretty sweet all the way around.

Oh and Mook, I'm with you on that part about the gov. spending us into total disaster
