Default Any OKlahoma people here?

A relative came by tonight with his latest wife. He was looking at some of my guns and showed his wife my ammo room. She is from Oklahoma and her father is retired from some branch of OK LE.

This lady tells me that:

1. The State of OK says a person can only have so many rounds of ammo per caliber gun in their home.

2. That a person cannot have a loaded firearm in a vehicle in the state unless they have a concealed weapons permit.

Is this correct? I have difficulty thinking she is and would love to hear from a OK resident with some firearm sense.

Yep. It used to be acceptable to carry a loaded shotgun or rifle in the window rack on a pickup, but I'm not sure it was actually legal. Now it's not a good idea. No ammo limitations that I know of, though.

Some folks just like to talk, even if they don't know anything about the subject.

This was this told to me at a TX concealed carry class - in OK it is permissable to carry a loaded handgun concealed on your person in a vehicle. If you have it concealed anywhere else in the vehicle it is a crime, even if you have a concealed carry permit from OK or reciprocal state.

This is false. If you don't have a CCW, then it is a crime to have a concealed weapon, even in your car. I wish we were like Texas which considers your car an extension of your home, and thus can have a loaded firearm without a license in it, but we aren't. If you have a license, it can be anywhere in the car. I regularly store mine in the console or glovebox, even under the seat.

I believe #1 to be false, and a search for "ammuntion" in §21 of the Oklahoma Statutes turned up nothing to support that.

As for #2, §21-1289.7. and §21-1289.13. of the same document would bear close scrutiny unless you are a permit holder. Basically, she's right.

I also searched Title 1 and 21 without finding any restrictions on ammo as to amount or type in the State of OK.

The issue of a loaded weapon in a car shocked me but apparetnly she is correct there.

This lady is in her 30's and appears to be level headed. She knows firearms well and discussed many models during their visit. Her father is about ready to retire from the State government having served in a support capacity to the State Police, apparently in their communications division and a firearm collector. She was unsure as to what amount was allowed but said there is a limit on the ammo one can have.

After my search, I turned to here since I could not find anything on it.

The loaded weapon law shocked me. I thought everywhere was included in the car being an extension of the home rule. Somewhere, and I do not remember where but it was not on the internet, I read that the courts considered the car as being an extension of the home and if one was travelling through another state, then their own state rules applied. Now I am not sure about the accuracy of that article.

I go to OKC and a small town named McLoud on occasion. When I have gone in the past, I have generally had 2-3 loaded firearms in the car, truck or motorhome. While also having a concealed weapons permit, I guess I was legal but .......... Ironically, I go to OK to visit friends and they each have a minimum of 28 yrs in law enforcement and none of them ever mentioned the law about loaded firearms in vehicles, knowing I always have some with me.

Now my question is why would someone want to carry an unloaded gun. What good would it be to someone? Why would a state want to prevent people from having protection inside their vehicle?

#1 is not true.

My understanding to question #2 is, that even with a CCW you cannot have a loaded gun at any time. Except if you reside on your property, than you can do whatever you want...

Oklahoma was the last of the wild west. Even after statehood, and into the 1930's, this was a rough place. Some of our criminals are thought to be partially responsible for the Federal firearms restrictions of the 1930s. Apparently, state government clamped down back then, and hasn't let up much since. We have CCW and the Castle Doctrine, but not open carry or car carry. It's getting better, but it's slow. We're working on it, but the anti-gun lobby seems to be quick to stir up all kinds of trouble any time we try to loosen up the rules.

This is absolutely wrong. Look up the Oklahoma CCW act and it restricts the concealed carry of a loaded weapon only in the typical places - bars, banks, courthouses, businesses that expressly forbid the practice, ect. If you are driving about, or shopping at most places, or walking in the park, you are allowed to carry a loaded weapon concealed, assuming you have a CCW license.

You aren't the first person to have understood it that way, a friend of mine never got his CCW because he thought the same thing. It took some serious effort on my part to convince him otherwise.

So I hope you haven't put off getting a CCW because you felt it was pointless, like my friend did. If so, now is the time to fix it

Even in TX, most LEO tend to prefer that you be traveling out of
your home county to carry a loaded weapon in your car.
It's kind of a gray area to some..
I have property in OK, and when I go up there, I can carry a loaded
pistol in the car no problem as I'm traveling and out of my home
county. But, I cannot cross the OK state line with it without a
CCW. So.. being as I'm cheap and don't have a CCW, I keep them
in the trunk the whole trip.
If I were to break down and get a CCW, I could carry it in the car
the whole trip. I've considered it, but being cheap I've never got
one yet.
I go as far as to keep the pistols and rifle in the trunk, and the
pistol I break down and put a cable lock on it. The rifle, I usually
put a trigger lock on it.
And I keep the ammo up in the car with me.. Usually on the passenger
floor area in my "gun" bag.
This was the recommended way to do it when I asked an OK LEO/game
warden about it on another forum. He said they don't like to see the
ammo stored in the same place as the weapons.
So.. that's what I do..
In Texas, they don't like to see you carrying a pistol in your car if you
are just driving around the city or county that you live in if no CCW.
This is where the gray area kicks in..

I know in Houston, if you are just puttering around town, not traveling
on a trip, and they catch you with a loaded pistol, it's quite likely you
will go to jail, regardless of the castle law.
They changed that law a few years ago.. It used to be the "traveling"
law. And many LEO still prefer to look at it that way even though they
changed the law enough to make it appear legal in theory in town.

They don't want gang bangers, etc carrying pistols in their cars if they
have no CCW. So unless they cut you some slack, most will jail you if
you have no CCW, and are not traveling county to county.
If I were passing through Dallas, it would be OK to most LEO, as it's
obvious I don't live there, and with all my junk, it's fairly obvious I'm
traveling. But a resident of Dallas would likely go to jail unless they
were just leaving or returning town from a trip.
So I don't carry one at all, as I'd have to stop at the state line and
stow it away, and I *hate* to stop for any reason if I'm making good
time on a trip. :/ I'll stop north of Dallas to top off the gas tank, but
that's it.

Most often, unless you break a law, you will not have the police looking at you or your car.

I travel over the southern part of the US often and I have several permits and a commission. Yet I have never had a problem and no LEO has ever asked me about firearms in the vehicle.

Granted there is always some type of profiling done for weapons, drugs or alcohol. Maybe they see this old, white, grey headed man and take pity on me or else figure I am too old to cause trouble. It could be they think I need all the help I can carry.

I have mentioned it here before but about 2-3 yrs ago, a LEO in an adjoining town saw a NRA sticker on the back of a car. He pulled the car over and found a gun. The gun was seized and that made the papers. The mayor of that town backed the officer and said when a person is stopped, they no longer have any Rights, including to keep and bear arms. Ultimately the gun was returned to the man and no tickets were issued on the primary cause for the stop. It was just an anti gun officer and the NRA sticker drew his attention to the car. No laws were broken and everything was legal but the man almost lost his firearm.

Keep as much ammo as you want... there's no such thing as too much ammo.

IF you have a CCW, you can carry a loaded firearm with you any where in your vehicle... as long as it's concealed. No CCW - firearms must be unloaded and stored apart from ammo and out of reach, preferably in a place that can be locked.

It should also be noted that the offense of Transporting a Loaded Firearm is now basically a moving violation. You get a ticket and the gun goes to evidence until the case is disposed. $70.00 fine. You won't be arrested unless there's another arrestable offense in play. A CHL holder can transport a loaded long gun in their vehicle. I'm in the iPad or I would post reference links.

If it's the one I'm thinking about, Tom Gresham had the guy on GunTalk to talk about his experience. IIRC, the "primary violation" was a failure to use a turn signal.

I'm not doubting you, but I would be leery of carrying a loaded long gun even WITH a CHL. Then again, my dad has been out checking cattle and has been stopped by no less than four game rangers over the years who were looking for violators. It's not something I'd "press to test."

A quick, semi-off topic (sorry) question--per OK law, is a loaded mag in the cab of a pickup and a cased rifle in the rear seat considered a loaded gun?
