Default When selling firearms on the forum....

Why do some people specify "your FFL must accept shipment from a private party"????? I know laws vary, but here in Wisconsin that doesn't work (MUST go FFL to FFL). Now, I have always been willing to pick up the extra $$ necessary to ship from an FFL, but I have lost out on at least three guns because someone posts an "I'll take it" while I am trying to find out if the seller will ship from an FFL at my expense. Just to add salt to the wound, all have said "Sure, I'll ship from an FFL if you pay for it..." but too late to close the deal. How about just posting "Shipping from an FFL, if necessary, will be at buyer's expense" ? Man, I wanted that last one, too...

I use my FFL on this end, but I'm not sure what the rules are as who can ship what to who and where w/o an FFL. Anybody???

My understanding is that under Federal Law an FFL can receive fom a non FFL holder. Many choose not to for whatever reason, just like a store refuses to accept a check or credit cards. I am not aware of a state law that would trump a federal regulation and prohibit an FFL from receiving from a non FFL.
But then again, I may be talking out of my Mitre

I'm a packerbacker and I get guns from normal Joes sent to my FFL... No problem!

Seems the folks I have been using have been a bit sly about what is law vs what is their policy! Perhaps I need to check around a bit and find an FFL holder that will allow me to spring on those good deals....thanks, guys

NY state shockingly does not allow an incoming shipment (handgun) to come from a non-FFL. Must come from another FFL.
Other states may have similar rules in place as well.

State laws vary and can be in addition to what the Fed law requires.

But even when there is no state law making that requirement, many FFL's do a self imposed rule as a sort of CYA (open to interpretation of it's effectiveness).
But it's their shop/business & they can impose that restriction if they so choose.

Some folks just are to lazy to go through the trouble.
Some just don't know how easy it can be done.
And some think that it'll put them on some Tin Foil hat conspiracy "list".

I've always accepted from private party shippers, the CYA is in doing the paperwork right.

As far as shipping...

By using an FFL you may catch a break on the shipping cost, as an FFL may ship USPS Priority..at a much cheaper rate,, HOWEVER if you ship, you are required to follow the shippers rules UPS.. YOU MUST go to a HUB.. and ship NEXT DAY which could cost you any where from $50.00 to $90.00...

An FFL depending on his volume may qualify for cheaper rates from UPS.. but nothing as cheap as priority mail.

Now as far as recieving, I can tell you most FFL holders will prefer to recieve FROM an FFL with a copy of their FFL...

Very few will accept a firearm from " Joe Sixpack" using only a copy of his drivers licence.... NOT illegal mind you..

But dealers choice!!

An FFL dealer may recieve a firearm shipped from an individual so long as there are no additional state or local laws prohibiting him from doing so. Some dealers worry about getting proper ID to enter the firearm in their logbook so they just won't do it as a personal business choice.

When I received firearms at the shop from an individual we required a clear photocopy of a drivers license, CCW or other state photo ID with the firearm info and a signature. This copy was kept as part of a separate transfer logbook in case there would ever be a problem concerning that firearm. Only had a problem once, took three tries to get one guy to send a CLEAR, legible photocopy of his license. Could not release the gun to the buyer until we had that and the gun was properly logged in. Never had a problem with a transfer from an FFL holder.

Shipping through my FFL is much cheaper than doing it myself.
I can usually ship a handgun, insured, for around $40.
I've shipped one revolver via UPS, within the same state overnight, and it cost me around $65. And that was going less than 500 miles. I never did it again.
I think some folks ship guns like they have a FFL. In other words, they ship Priority Mail or use UPS ground. This would be cheaper than going through an FFL, but is not legal, even with proper id enclosed.

I've come to learn this the hard way; in the past, I have never been able to ship a gun to an FFL via Priority Overnight Fed Ex for less then $75.00.

It's infinitely cheaper to use an ffl to ffl transfer...it's cheaper and legally unimpeachable.

Even as a dealer I run into FFLs like that on occasion, for some reading the regulations takes a bit more effort than they are willing to invest.
