Home invasion 1/13
My home in Arkansas was invaded last January during duck season. Just curious what you would have done. About 10 pm I stood up to put my unloaded shotgun in the boat bag. My partner who is a 45 year old Tia Kwon Do instructor was sitting on the couch and his 17 year old son was in the recliner, my brother had just headed down the hallway for bed. At this time I heard the screen porch door open which is unusual for this time of night, then the storm door opens and this guy comes busting through the front door about 12 feet from the barrel of my shot gun which was pointed at his nose. What would you have done?

I hope I would have settled for a hard muzzle to the nose but ya never know when an AD might occur.

Did you need a good mop? I would think the BG would have a serious fight or flight reaction, and void every ounce of fluid he could while turning to run far and fast.

Not enough info.
Did you recognize the guy who came in? I mean, was it your brother who had inadvertently gotten turned around on his way to bed and was coming back into the house? Was it your next-door neighbor who had just found your Labrador retriever wandering around the neighborhood diggin' up ol' lady Fleener's roses? Or maybe it was poor old Charlie Gruberman, the town wino, coming home from a night with the boys, and got your house mixed up with his. After all, the tract homes in your subdivision all look the same.
Or, may be it was your wife coming home early from her mother's, who lives in a neighboring community, after deciding not to spend the night there after all.
Or was it the notorious Jimmy the Creep, whose picture had been plastered all over the ten o'clock news for breaking and entering and torturing an elderly couple while they were watching Dancing with the Stars?
Lots of variables here. Basic rule of firearm safety...always be sure of your target.

Way too many unknowns for me to comment regarding my course of action.
Description of subject? Subject armed? Weapon(s) in hand? Door locked? Nearby homes that may look alike? Type of dwelling...single family, apartment, townhouse? Reactions of others present? And much more...
Most important...what did YOU do?
Be safe.

I have a friend who had something similar happen to him.
He asked the guy; "What do you want?"
The guy said; "I want to be somewhere else!"
My friend replied; "Okay then, off you go."
My friend's name is C.O. Jones.

I would see if I recognized the face on the business end of the barrel. If not, I'd make him freeze and call the local gendarmes. Then I'd make him clean up the mess he made on the floor.

Too many variables and unknowns in the scenario the OP posted. I'm not sure if he was trying to "bait" us or what.
Knee-jerk reactions to sketchy scenarios, such as this, give the anti-gunners the proverbial ammo they thrive on in order to make such comments as, "See? They're willing to pull the trigger on a shotgun only to find out that it's the paper boy making late-night collections!"...or something just as asinine.
Like I said before...not enough info to make a rational judgement.
Be smart and stay safe.

I would be very interested in hearing the rest of your story. I had a somewhat similar situation happen to me, but I was alone and had a Colt's Government Model (.45ACP) in my hand at the time. Yes, it was cocked and locked. Before I could say anything, the intruder said "Do you know Sam Smith?" My response was "Do you know Jesus Christ? You're about to meet him." He left promptly and I had the "jelly legs" for about an hour afterwards. I phoned the police to report it (this way before the days of 9-1-1) and the Desk Sgt., once he quit laughing, said "dang, that was pretty good, what do you want us to do about it?" I doubt he would get away with such a response today.
Regards,
Dave

The OP seems to have left the building.
Perchance he was wondering what he should do (should have done?) ...or preparing his defense based on our "expert/professional" replies.
Be safe.

I never saw a weapon, and knew I had the upper hand, but I did not know who this guy was or what he wanted or if he was wanted. When I told him he needed to leave, he told me he was a ten year Marine vet and had seven years mixed martial arts training. That's when I put the gun down and asked him to go outside and finish the conversation, he said, you mean hand to hand, I said it didn't matter, he could walk out the front door or be carried out the back. My brother in the mean time had called the land owner who called the sheriff. They arrested the guy on felony home invasion. I told the sheriff that I had thought about shooting the guy but never saw a weapon. She told me he was lucky I didn't shoot him because most folks around here would have. I thought it was cool that I heard her tell him that if he came back, that, that man will kill you. The Sheriff came by later and told us the guy was from California and had a long wrap sheet, they think he may go down for a long time. I am still glad I did not shoot this guy, it would have ruined the next morning hunt.

Funny thing about God's will, you don't recognize It when It is unfolding. It turned out the way it should have for you, the offender, maybe not. You are what matters. Joe

I was hoping that was the answer. Good man, never go around unarmed, it's not good for your health 'cause you never know what may walk though that door.

When you say the guy came through the front door, was it unlocked? Highly unlikely scenario at my house.

This guy told you he was a martial arts expert, and you PUT DOWN the gun?
I once had a jerk try to get in my window in a motel. Got up and waited with a M-29 .44 Mag in hand for him to enter. It was the gun I had on that trip.
His wife came along and claimed him. He was drunk.
Lock your doors.

The news could have reported:
10 year combat Marine with 7 years MMA experience breaks into home of a local hunter who has less than 20 minutes range time with his new .45.
Funeral for the MMA fighter will be held next Tuesday, 8am, St. Joe's Parish.

If he had
If he was a Marine with years of martial arts experience, he would not have stopped to explain it to you. I too, am glad that you didn't have to ruin your day by having to shoot somebody.

I'm glad it turned out well for you. But I certainly would not have put the shotgun down. Even if unloaded it makes a heck of a club. And who knows if there was a second or third bad guy just outside the door? Looking down the barrel of an empty shotgun is still scary.

Great, a thief AND a liar. He'll fit right in in the joint.

Bingo, I knew he was full of ****. I still don't know what the final outcome was, but I will find out. I will definitely be buying the sheriff coffee when she has time, you can never have to many friends, and she's kinda cute as well.

Years ago I was up about 11 pm watching tv. There was a knock on the door and a black guy about 20 years old wanted to know where the party was. I had my nickle 2 1/2" python in my hand on my off side. I never pointed it at him with it, but brought it from hideing and gestered down the street and told him, "It aint here so git". I really thought I was going to have to shovel up his eyeballs off my doorstep!
A better one though was back around 1965 I rented a little one bedroom house in north hollywood. I had a friend that was a lot older than me. He had flown his own airplane from back east to find a job in california. He had been staying by a brother that was a wheel in one of the movie studios. One day carl showed up at my house all beat to hell and a real mess! He was too ashamed to show up by his high class brothers house looking like that and wanted to stay with me a few days untill he healed up. Somehow his brother found out he was staying at my place. He showed up and they talked a few minutes. Then he said, follow me out to my car, a got your mail. (He drove a lincoln continetal). Carl went out with him shirtless. He also was black and blue all over besides his face and it was super hot and I had no AC in that shack.
Soon I heard someone hollering, stop you XXX etc. Then I hear people running towards my door! Carl came running in with my neighbor chaseing him who lived in a identical house on the same lot. Both flew into my house one behind the other! My neighbor also had his shirt off. He was a real fit professional hollywood movie stunt man. Turned out carl had his head down reading his mail and walked in the wrong house while the stunt man was makeing love with his wife on the couch! I got it straighend out but it was hilarious!
A side story here was I had met carl in a bar. We were talking flying and I had just started lessons. Carl said I have a plane but no car. Lets go flying. You got to drive us to the airport. I thought, yeah sure, and figured him for a drunk braggart and decided to take him up on his bluff. He wasnt bluffing, and we went flying. He later got a job at lockheed where I worked. We became friends. Once he mentioned he used to instruct at a town in wisconsin where I got my first ride. I went home and looked up a picture my mother had taken with the pilot, I and my sister in front of the plane. Yup, it was carl!

I went home and looked up a picture my mother had taken with the pilot, I and my sister in front of the plane. Yup, it was carl!

He had a piper tri pacer. I later bought myself one but mine had been metalised. Looked just like the factory had done it. I later crashed it. The plane he flew my sister and me in was a stintson. That was at wawatosa wisconsin about 1953 when I was 12.
Carl was a heavy drinker. He claimed he must have got out of line and some burbank cops beat him half to death and left him lie there. That was close to the same time the same thing happened to the singer "Jimmy rodgers" in northridge. Remember the song, honneycomb? I am not cop bashing as I have and had many friends that even were on those same departments years ago. I just belive in telling what I belive to be the truth as told to me and let the chips fly where they may.
Carl, "Mac" Mc kinney had mostly been a flight instructor and crop duster up to when I knew him. Later he was a machinest at lockheed. He would be in his 90s if still alive. I know he was on a aircraft carrier durring the war. I belive carls brother ran the garage at warner brothers studio.
One time carl and I went to encidnada together. Someplace I have a photo of him outside the cheap motel. I was clowing around and locked him outside when he stepped out to my car in his pajamas to get something.

I'm curious to know what constitutes/justifies a felony charge in this case vs. a simple misdemeanor trespassing??

Entering the home makes it burglary rather than trespassing. Entering an occupied home makes it a more serious form of burglary (at least in MN). If the guy wanted to get charged with trespassing, he should have stayed out in the yard and refused to leave when told to.

I'm not real sure, I do know that terrorism was mentioned as well. It may have something to do with him making threats, I don't know. He did have a wrap sheet and they said he was bad news. One of the cops said we should have shot him, it was probably tounge in cheek, but it was said. The one thing I do remember was being a split second from breaking his jaw, I saw my fist going across his jaw, his head bouncing off the door jam, and him sinking to the floor. Please don't think that I think I and Rocky, but I have knocked a few out before, and I was ready to try it again. Course I could've missed and I wouldn't be telling the story.

Weren't you at the trial? Didn't you testify?
I, for one, would surely want to know what the disposition was for someone charged with a felony for "home invasion" of my home.
Be safe.

That reminds me of this story. Years ago my life long best friend lived next door to me. Through him I also became friends with his brother hans who was a deputy from the new orleans area at the time. He was visiting bill next door.
I was at work as a guard at lockheed about 4 miles away from my house and it was about 3 am.
I spotted a house fire at what I thought was very close to my house and since not much was going on I took the patrol car home and the closer I got I thought DAMN!, that might be my house! It was larrys, a outlaw that lived directly across the street from mine. People were gathered looking at the fire. Bill and his brother hans were also standing there. About that time larry pulled up as the bars were closed. He was told in front of us the fire was started by a molitave cocktail! He said I wonder who would do that? Hans said, "someone burnt my house down, I damn sure would know who done it!" Big D, you remind me of hans! Thats a compliment!
Later larry did time for robbing a credit union. He was drunk as a skunk and went through the drive through and was so drunk and dumb that he gave a holdup note!
I didnt see him again untill about 20 years later. I and a GF went to laughlin. It was a super hot day and I was looking for a parking place in the covered garage at the gold nugget casino. I passed a empty spot, stopped, backed up and started to swing in. The GF yelled theres a body! I got out and started to check him out. No blood. I thought he must have got rolled and was looking around. A big old guard arrived about then. I noticed the guy was breathing and slapped him on the gut. He sprang up and said I just drove in from palmdale and had to lay down. It must have been a 115 degrees and he had passed out right on a very dirty grease spot! He had a beard, it was 20 years later but I then reconised him as my old neighbor larry turner from palmdale! He didnt reconise me and I darn sure wasnt going to admit to knowing him!
