Angry Need some advice and a smarter son.

Baby Boy co-signed a personal loan with his "at the time" girlfriend so she could get some "perkies". Shortly after he finds out she has a problem with her knees and sends her on her way. Now she is intentionally not paying the loan so he will have to. The bank just called him again and said she had not made the payment for July and that he needed to.

Are there any legal remedies that he can use to "persuade" her to pay for her own bill? Is small claim court an avenue or is he married to the load until it's paid off? We are talking about Florida laws.

I think I know what 'perkies' are, just curious about 'knee problems'.

S C - if you posted pictures of the "Perkies", would the thread get locked?
I'd have your son get some local, legal advice BUT..............
I've never heard of a happy ending on these stories.
I'm sure you already know but cosigning a loan is more than a favor and it carries some big responsibilities.

Tom, keeping 'em together is the reference.

SC, I'd check with a lawyer, but my bet is that it is an expensive life lesson for your son. On the upside, it is a useful lesson.

JMHO but don't bail him out or the lesson will never be learned. He should take her to small claims court .

It happened to my son too and she left before they even healed ,so it did him no good at all. She even took his genuine US Navy flight jacket which I gave him.When some parts are hard other parts are soft.I remember when all too well.I guess I aint That old.

Perkies would be like losing the twins. I wonder if he couldn't find a lawyer to give him shared custody. Can't imagine paying for them and not even able to enjoy them.

Not every time. I co-signed the first loan that each of my four kids got on a car. They never missed a payment to the finance company or credit union... but they knew what I'd have done if they had missed one.

I'd tell him it's part of his humanitarian giving to others. Sounds like many will benefit from, and be thankful for, his generosity...! He gave, so she could give some more. Etc., etc., etc.

I agree that it is a good life lesson. We all have them, and hopefully learn from them. He's young, he'll rebound!

It seems like every time some guy's live-in love monkey wants enhancements, she makes him believe that she's doing it for him. And the sad thing about it, the poor schnook actually believes her. I guess it's true when they say, "Love is blind." If it's not blind, it sure as heck needs glasses!

If the bank won't give her a loan ... red flag. I know a really smart guy co-signed a $100k loan for his best life long friend to expand his gunshop. He paid

I would NEVER EVER cosign a loan, unless there were some perkies invoived.

^^^ This. My wife cosigned a school loan for a gal pal of hers. To my knowlege (a shame when you have to add a qualifier like that ) we never got out of pocket but the gal was constantly late & we got phone calls about every other month.

The "I told you sos" I got to hand out weren't nearly worth it...

Ok, so your son co-signed a personal loan so his girfriend could get
some money to buy "perkies", and now he is claiming to be a victim in
this little game because "she" won't pay the money back. The "perkies"
were for her and no doubt gone in one night. Your son knew about her
knee problem and that's why he did whatever he could to try to keep
her happy, for a little while at least. Now "Baby Boy" is crying to good
old dad about getting scamed. Your son knew she had no money and
surely never really expected her to pay back the money. This isn't the
kind of rip-off you're going to take to any court. Does your son live
with you? Have you helped him out financially before when he had
problems? Your son needs to be smarter but may be a bit smarter
than you think he is. Maybe good old dad needs to get a little smarter.

Re never consigning, I don't agree with that. Just gotta be real sure who you are consigning for, and why.

I consigned for a couple opening a restaurant, but the missus and I had known them for over 20 years. Hard wioking and focused couple. They paid it back, in full, and no issues, ever, for me.

Restaurant is going gangbusters.

Perkies is definitely a young man's mistake.

But, SC, you can point out to your son that the most powerful guys in the world do stupid things when it comes to the ladies -- Bill Clinton, etc. -- so he does not need to beat himself up over it forever. Just man up, do the right thing, take his lumps and move on a wiser man. Hopefully it is a lesson that takes.

I agree that you should not bail him out. Lesson would be lost if you did that.

Under Louisiana law your son is SOL. Regardless of the underlying reason for the loan-the reason why a lender requires a co signer is because the lender doesn't think the borrower will pay back the loan. Period.
If a sophisticated lender has made that decision-it would behoove the proposed co signer to think carefully as to his second guessing a loan institution and signing off believing the entreatees of the borrower that he/she will pay back the loan and that the co signer signature is a mere formality that will never come back to bite the cosignor. Sometimes that lesson is learned the hard way. I can't tell you the number of people I see regularly who have gotten themselves in this trick bag. It's really sad.

This is unavoidable logic, and SHOULD not even require stating. In fact, however, it does, and should probably be some kind of a test question on every test in every subject for all four years of high school. And some people would still ignore it.

I was pretty sure that would be the outcome, but just wanted to see if there was a possibility. I'm sure FL law is about the same as LA law. It was as much of a venting on my part as it was a question/asking for advice.

Some here are right. Some made funnies and I laughed at them too. One made a character attack on my son and then threw a rock at me. I'm too old to duck/dodge bullets any more. Now I just shoot back.

How's your snapper season going over there? Ours has been an absolute flop. Red grouper too. Having to fish hard to catch 18" fish and still haven't caught a limit of red grouper. Last year 4 or five of us could be limited on both and headed in by 11 AM.

Bankers call cosigners "Idiots with a pen." I cosigned for my daughters apartment. She now "owes" me almost $60,000. I did it with my eyes open.

I am not a lawyer, but I suspect your son will be paying for an expensive life lesson and without knowing anything of the young lady's finances I doubt he can compel her to pay. If it is really a large amount of money perhaps he can declare bankruptcy. Otherwise he is on the hook.

Senior Citizen,

You posted the below about three years ago. Is this new thread the continuing saga of the girlfriend with bad knees and the car your son bought for her that she was going to make payments on after your son kicked her out of the house?

Promissory notes/contracts legalities and enforceablilties.

I was a slut magnet. I didn't get it until I was in my 30's.

When I knuckled down I met a good girl. She wasn't gonna let me get away. We've been married for almost 11 years now and I can't imagine being with anyone else.

Some of us take more time to grow up and that usually means we get to pay.

I work with several women who have had this procedure in the last few years. Two of them got a "special" that a local plastic surgeon was running and paid $3,500.00 each for the procedure. Each, meaning person, not left and right sides. Another spent some $10,000.00, but she had other things done at the same time. One lady was rebuilt after a masectomy, no idea what her bill was but it was a remove/replace procedure.

The doctor who pioneered breast reconstruction is here in Atlanta. His firm does REAL good work. It should be noted that while lots of cosmetic procedures are done by choice, some are necessary. Masectomies used to leave horrible scarring...some resembled butchering. Imagine going through life like that? The invasive disease and surgery are scarring enough for most women, it is imperative that their bodies be returned to normal, or as close as possible, very quickly. This actually helps them heal, mentally and physically.

Hard to imagine forgetting a lesson about loosing money.

Not to sound callous but it's his problem after the first weather he got it resolved or no, should have learned the first time as he could have paid for that one also.

I would like to know how many people here that said they never would co-sign for anybody had someone help them years ago when they were starting out?

I'm not sure if this will help as my advice comes from watching court tv programs, however, you may want your son to check into the binding legalities of primary responsibility in Florida; even though he co-signed. He may be able to countersue and recoup some of the money.

The whole "knee" issue has me curious. I'd that a reference to cheating?

In NC, if the amount is under $5000 he can file a Magistrate Summons/Complaint for Money Owed. Once she is served they will have a court date in front of a Magistrate.

I feel bad for your son. Obviously he exercised poor judgement, I hope he learns his lesson.
