Florida Backyard Shooting Range
A man in Florida, residential area, set up a range in his back yard and the officials are having a cow as they can't do anything about it!!!
Under Florida Statute 790, gun control is solely under state, not local, jurisdiction. The only state restriction on recreational shooting on private residential property is that the bullets cannot fly over a paved public road or an occupied dwelling, and that shots cannot be "reckless or negligent."

So according to this I can shoot in my backyard.?? I live in the suburbs within the City Limits. City ordinance prohibits shooting of anything, BB guns, sling shot, Bow and arrow. So this article says the City can not restrict the right to shoot??
If I was outside the City limit and just in the County then perhaps
Taking up a collection for legal fees.

this has been on the front page of local paper free press. he even has a fellow officer shoot with him. this situation is pitting neighbor against neighbor. he does have a backstop and dones it in a safe manner why doest the county have a public range? they are trying to shut him down because a neighbor in another county accidently shot someone, was there a backstop was he hunting who know i want to. he does tell law what time and what day he will be doing this

The State Law PREVENTS LOCAL ORDINANCES concerning firearms.
Localities CANNOT REGULATE FIREARMS, only the State. WOW!!!!

Here's what the law says.
Statutes & Constitution :View Statutes : Online Sunshine
"Any such existing ordinances, rules, or regulations are hereby declared null and void."
That's pretty clear.
I believe GA has such a clause, but I believe GA law allows cities and municipalities to make ordinances restricting discharge of firearms. I'll look it up.

Florida Game and Freshwater Agency only recognizes a Dirt back stop.
A law that is sometimes used is "Breach of the Peace" if a complainant is a "Friend" of the County Sheriff (i.e. big contributors of money /votes) and doesn't like the "Noise".

Not sure what is meant by residential neighborhood. Does it mean suburbia with 100x150 lots? If so, then it sounds dangerous to me.
Do the lots have acreage in this residential neighborhood. All that makes a big difference. Never get the full story. I also agree that the unavailability of ranges nearby (in the gun-shine state?) is really strange.

Thanks for that link.
I am aware of the battle of State vs Federal on the concealed carry laws for example we used to have laws prohibiting CCW in Public Parks, Beach etc. They had to change all their signs. I understand the law cover that the State can not deny that right. In the statute above I see nothing about the discharge of firearms within a City Limit?
Perhaps some of the legal eagles can interpret this? I am not going to be a test subject. But I here they have internet in Prison!
PREEMPTION.—Except as expressly provided by the State Constitution or general law, the Legislature hereby declares that it is occupying the whole field of regulation of firearms and ammunition, including the purchase, sale, transfer, taxation, manufacture, ownership, possession, storage, and transportation thereof, to the exclusion of all existing and future county, city, town, or municipal ordinances or any administrative regulations or rules adopted by local or state government relating thereto. Any such existing ordinances, rules, or regulations are hereby declared null and void.

I don't mean to hijack the thread cause I think this is hilarious and I hope the guy makes it stick but did any of you watch the short video at the end of the article? It's about two schools being built close to a shotgun range that has existed since 1961 and the media is outraged. Check it out. Listen to the words and inflections used by the reporter.

I live outside city limits. If I were to touch off a round in the yard, every cop living in the neighborhood (about 1/3 of the homes) would be giving me more than the "I work the graveyard shift-SLEEP in the daytime" lecture. Joe

I'm wondering. FL law used to state that cities could not pass ordinances that were stricter than state law but there was no enforcement clause so cities just did what they wanted. You had to sue the city to get it overturned. I know a couple of years ago the legislature tried to put an enforcement clause into the law which included a fine and (I think) jail term for mayors and councils who broke the law. But wasn't that overturned by some judge? If it was, this law is most likely a reaction to that.
