Default Gunbroker seller/shipping problem

I just picked up a Colt Police Positive from a Gunbroker auction and sent a USPS money for the purchase price plus $35 shipping along with my C&R FFL. Everything got to the seller just fine. Now,here's the problem. They only ship via FedEx 2nd Day according to their ad. I work during normal FedEx delivery hours. So, I simply requested that no signature be required for delivery ,at my risk, as I have done numerous times in the past without incident. They are refusing to ship insisting that I find another means to receive it (ie "Do you have a dealer you can use?"). It is not like I'm asking them to break the law. Well, frankly, I think that I have paid the freight & they need to figure out a way to get MY gun to me. I shouldn't have to add another $25 in FFL transfer fees to the price of a $310 gun when I have a license to receive it.

Am I off track here?

They don't want to be liable for the loss of the firearm and aren't going to risk it.

did they expressly say that they would only ship with a signature required in their auction listing? if so I understand them sticking to their procedure. if not and they won't accommodate your shipping concerns and you can't work anything out with them ask them to refund your money.

Have Fedex hold it at their shipping hub in your area and figure out a time to pick it up there. (maybe the seller had a bad experience once)

I wonder if you could have FedEx hold the shipment at their terminal and pick it up there? Edited to add that I see Mr. BKreutz beat me to the punch.

In the past, when I have had items arrive at my house when no one was there to sign for it, FedEx would leave a form behind for my signature. The driver would then pick up the form with my signature when he delivered the next day.

On the form, they also provided a phone number for the local terminal so that I could call and arrange to pick it up if I were in a hurry. Both methods have worked out just fine for me.

A call to FedEx should tell you pretty quickly what they can do for you. 1-(800)-463-3339.

I am pretty sure Fedex requires the signature option for a handgun delivery, even if it is a C&R purchase.

Have it sent by priority mail. If you're not home the carrier will leave
a form in your mail box and you can pick it up at the post office.

I had a situation several years ago that still lingers with me.

FedEx delivered a package containing a revolver while my wife and I were out to supper. We returned, parked in the garage, and entered the house for the night. The next morning I found the package on the front porch, along with the newspaper. Completely unsecured for about 12 to 14 hours.

I assume that the Colt Police Positive that you purchased remains in functional condition, even if it is "C&R eligible". If that is the case I wonder how you might feel if your paperboy had found it, took it home, showed it to his friends, found some ammunition, and an ugly incident happened.

I would suggest that your seller has acted in a thoroughly responsible manner to safeguard (as much as possible) the security of a firearm in transit to the lawful purchaser. I think the lawyers refer to such things as "due diligence".

I would not be happy to lose a $310.00 investment, but I would be more concerned about other possible consequences that might result from leaving a firearm unsecured, even for a few hours.

You can ask FedEx to hold the package for (up to ?) 5 business days at their nearest company facility. Mine has late hours, so I can go after work.

Have done this several times, never an issue.

Or sign up for a (free) FedEx account, and put a vacation hold for delivery if you don't have a tracking number. Just remember to take ID with matching address (mine asks for two photo types, but the second can be as simple as my photo on the bank card).
