Default Here's a twist...Mandatory gun ownership legislation in SD.

I found this to be pretty humerous. A couple legislators in SD introduced a bill that would require citizens to own a gun. It's apparently a play on the government requiring healthcare.

Makes sense to me. However, it does not prescribe any penalty for failure to comply. Might have some legal implications in certain types of civil suits, though.

Did the same thing in Kennesaw, Ga, they have the lowest crime rates in Georgia..

Having lived out that way, I think everyone in SD already has at least one gun so what is the point?

There is actually some precedent for requiring citizens to keep and bear arms. The militia was commonly understood to consist of all able-bodied citizens capable of acting in defense of the community, and a number of communities required each householder to maintain arms and ammunition at all times. Exceptions were made for those who were religiously scrupulous, but such exceptions came with fees required to provide arms and ammunition for others who could not afford the costs, thus balancing the duties of citizens rather neatly.

So, an interesting concept that has legal precedent going back to pre-Revolutionary War days.

The obvious comparisons to the current healhcare debate are troublesome, however. Requiring citizens to buy anything, and punishment for inaction, actually seem to expand the scope and powers of government beyond anything anticipated by the founders, or permitted within the Constitution.

Except that unlike medical insurance "To provide for the common defense" IS a task assigned to the Federal Government by the US Constitution.

The scary thing about mandating anyone to have something under penalty is it will have the exact opposite of the intended affect.Guess what is happening to the rates of those who have private healthcare insurance? It is going up.This is what happens when you have a lawyer trying to overhaul something he knows nothing about.If this becomes law the bumper sticker I saw today will become true."Wait until you see how expensive healthcare is when it becomes FREE".......Mike
