Default Background check for CCW

An old friend wants to get a Texas CCW. Back around 1971-72 he was married to a vile and ill mannered woman, and they had a child. A decade or so later he brought his daughter to his ex's house to drop her off. His ex made a snide remark, to which he replied somewhat in kind. At this point she made a haymaker swing for his head. He threw up his arm and blocked it. At this point he gently, and I mean that, gently slaps her cheek with the tips of his fingers. The next week he finds out she has filed charges against him, so he goes and sees the police about it. When the court date comes around, he shows up, and she doesn't. Charges are dropped, end of story. Until, the early 90s, and then he tries to buy a gun, the first time after the Brady Bill passes. They get a red flag on him. He goes to the sheriff or whoever was over the process, and they get it cleared up, and from then on, he has no problems buying firearms. This man has had security clearances with civil service and has worked on missiles here and abroad. What we want to know is, will this old issue of a domestic confrontation, going to give him a problem getting a CCW in Texas? He is 58 now and has no other instance like this.

Did all this business involving the ex wife take place in Texas or elsewhere?

I don't understand why he wouldn't just go apply for his CCW in any case? This unfortunate business all took place 40 years ago. I'd be shocked if it created a ripple, but if it did, he could then appeal it and try to remedy the problem.

It seems to me he won't know until he tries, but then I don't live in Texas.

I was assaulted by a panhandler 25 years ago in California. A police cruiser happened to roll up and saw me whacking the guy, so they arrest me! Just applied for my ccw here and got red flagged. I had to get records from the court to prove it wasn't a domestic issue. They take it very seriously.

It took place in Texas as I remember. We live in the Texarkana area, so it could have been in Arkansas. My friend was scared that if he didn't pass the background check, that he would lose his CCW class fee.

Here's what needs to be done.
When applying, he needs to list the arrest and have the actual court papers showing the disposition of the case. If your description of the outcome is accurate, then he will get the license; if he was convicted, that's a whole different problem.

Why list it and submit the paper? The offense as you describe it is not disqualifying.
Intentionally omitting required information is an automatic disqualification and forfeiture of all fees.

He can call DPS and discuss the issue with them prior to applying if he wishes.

I agree 100% with OKFCO5. I got my CCW in Oklahoma last year. We were told in the CCW class to list everything related to any records from our past (with appropriate documentation) on our application for the reason as stated above. Good luck with your application.

List everything? really. How dumb. I say if it's not already in your police record.....They do not need to know. And can big brother charge anymore $$ for various BS. I am loading up b4 we are only allowed to have 'X' amounts or kinds of weapons. It's easier for a criminal to get any kind of weapon then it us for us law abiding peeps.

Chadj, first, welcome to the forum, the issue here is not telling them something they don't know, it's not telling them something they already might know, or something that may not be expunged, that was supposed to be. Well of course it's easier for crooks to get guns than us. They will break any law to get or carry one.

In Texas, it will not be a problem if the charges were dismissed. Dismissals will not be grounds for denial, as long as you were not placed on probation or deferred adjudication prior to the dismissal.
