Buying & selling
Well I like most of you checks the local papers, and once in awhile see items priced decently. Recently found someone selling a couple firearms, that I thought I might be able to flip for a small profit, am I just getting myself into more trouble than it is worth.

I make it a point to not buy guns, with the intention of reselling, unless I would like to own that gun myself. That way, if I either can't find a buyer, or can't get the price I want, I'm not stuck with a Hi Point or a Glock or a Taurus or something else that I wouldn't want.

Taking a chance to make a "small" profit is not worth it, you could be stuck with the guns for awhile. Now if you can buy a RM for $1000, that's another story.

Shipping costs, insurance, & dealer fees for transfers dictate that a re-sale, if not face to face, requires at least a modest profit to break even. Or I could say "what ladder 13 said!"

I always buy guns that I want to keep. But then some times I buy a gun that I think I want and then change my mind. About six weeks ago I bought a Ruger MK III new in the box. It has the 5 1/2" barrel. Now I think I will sell it. I just have so many 22LR hand guns. Don

In most free states, face to face transactions between residents do not require a 4473 or a FFL. For example gun show private party sales.

From the 4473:
"A license is not required of a person who only makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of his or her personal collection of firearms."
I think getting a good deal on some guns, then selling them, would count as "enhancement of a personal collection or for a hobby" rather than operating as an unlicensed dealer.
I think you'd have to show a pretty high volume of purchases and immediate resales to run afoul of the law.

This would be 2 or 3 purchases. In Maine a personal transaction does not have to go through a FFL.

A couple of thoughts to consider.
The issue with ATF is worrisome as the definition is vague. What is occasional to one person may be doing business according to the ATF. In today's environment, regarding firearm sales, making an example of some poor sould who crossed the line, acording to the agent's defintion is more of a reality than folks give it credit for. This is certainly a fact along the border.
In my opinion, now is not the best time to buy guns with the thought of turning them for a profit.
Now this comes from a person that used to be a trading, swapping, buying, selling fool. Not necessarily for profit, in fact, I lost money on many, many transactions.
I am not saying that if a really good deal presented itself, that I would turn it down, but I would be very careful, and would know with whom I was dealing with.
Do not want to be a downer, just want you to be aware of the environment.
