Are you pushing up on the slide release ? When empty the top of the follower in the magazine pushes the slide release up to lock the slide back. With no magazine there is nothing pushing it up. So you have to do it manually.
it won't lock back.... period. it doesn't hold...it can be laying on the table slide lock backed and it will just drop closed on it's on. Now it won't lock back at all.

"Notch" in slide may be worn or slide stop itself. Does slide stop move completely up? Check for wear.
