According to this link (Calif. DOJ, read #5 and #6), it seems that you can give it to one of your parents and they can give it to your brother legally without any paperwork since it is not a handgun. Handguns require you to go through a FFL dealer. It doesn't mention here anything about residing in different states nor does it say anything about transfers between siblings.

This second link is the CalGuns Wiki. It states that intra-familial transfers and ANY firearms where the involves parties reside in different states MUST go through an FFL dealer, again doesn't state anything about siblings.

Bottom line, since family members (parent/child, grandparent/grandchild, husband/wife) need to go through an FFL dealer, you probably will too.

Oh, one more thing, this is all based on that your brother is not prohibited from owning a firearm.

Assuming, from your AZMOM name, that you are in AZ, make sure that your 15-22 is California approved. The compliant model has a fixed stock, a 10 round magazine and no flash hider. Most of them here in AZ have adjustable stocks and 25 round magazines.

Actually, just the magazine. Adjustable stock and flash hider are legal in CA for this rifle.

this is a murky issue on this forum...it actually can depend on municipality--Local regulations in the Peoples Republic of California CAN and sometimes DO dictate a fixed position stock ( an extra pinset from the factory) and NO flash hiders/ barrel shrouds

my suggestion in addition to this gentlemans very thorough ( and informative!) links is to call the sherriff department in the county your brother resides in and ask a few questions

I'm sorry, but there is no truth to the first part of this post. There no laws beyond fed and state in regards to firearms.
The Ca Aw laws DO NOT apply to rimfire.

The only issue here is importing or transfering the magazine if it is over 10rds. Option one is let him buy a 10rd mag locally. Option two is you break the magazine down into parts, which he legally can receive as they would be considered parts, after which he would need to block it off
To only 10rds

Furthermore, the transfer needs to go through a FFL if it is over state lines

The easiest thing for him to do is move out of Kalifornistan until/if it returns to normal.

You really don't have to do anything except send or take the rifle to a California FFL. Your brother will jump thru any number of hoops to take possession of it from the FFL. But those are his hoops, not yours.

It's not illegal to transfer money across state lines and you don't need a FFL to do it. If there are too many hoops sell your rifle, give him the money, and he can buy in CA. You were giving it to him, right?

I personally was wondering why this wasnt the better option considering the confusion and the red tape and BS the transfer will entail ( provided you find an FFL that doesnt try to screw him and keep possession of the rifle to sell)

if you post it for sale on the forum for a reasonable price i can assume it wouldnt last long

well, we are working on the local "assault weapon ban"
but even if it were repealed, it would not effect

1) transferring the gun
2) the issue of importing a magazine that holds over 10rds.

OP, go to calguns.net to search for a reputable FFL near your brother.

This really isnt that complicated guys!

Why would any one want to part with there 15-22 LOL

Remove 25 rd mag.
Give gun to a parent.
Parent gives gun to your brother.
Brother buys 10rd mag.

End of story. FFL not required.

If you are really paranoid, have the parent take it out shooting a few times before giving it to your brother.

I don't know why you guys are making such a simple thing so difficult.

Haha that may take a while. I wouldn't hold my breath. I contemplated moving to AZ a few weeks ago. Not just because of the heavenly gun laws but because it's much cheaper to live there.

OP, trade the 25 round mag for a short 10 with someone.
