Default BAD NEWS

Well guys it was bad news today with my firearms certificate

being revolked by the police due to me having a rare

incurable but treatable blood cancer.........

My 2 fully loaded 15-22's will be up for sale :-(

That is awful news on both counts.

Is there no movement with it? At all? What is the rationale behind that decision??

W...seriously....that absolutely sucks! So by that reckoning all our firearms must be revoked because we could all die of an unsuspected heart attack or suffer a stroke.

Keith i am appalled and devastated for you, you must be really.....(must watch language) ticked off.

What kind of deadline do you have...what if you don't sell it do the po-po 'dispose' of them.

Is there no possibility of appeal?

Sorry to hear of your bout with cancer. I'll pray for you to have the best of outcomes.

I hope you can work out the possession of your firearms so that a nearby friend can hold them for you, and you can still shoot them.

So sorry to hear that Keith. That's absolutely appalling!!! What the h*** has it got to do with shooting. I too hope you can appeal their decision. If not move down here to Devon as I am sure that D&C police would be a lot more understanding than GMP!!

Q237: How/why are firearms certificates refused/revoked?

A firearm certificate may be fully revoked by the Chief Officer of Police for the area in which the holder resides if he has reason to believe -

That the holder is of intemperate habits or unsound mind or is otherwise unfitted to be entrusted with such a firearm; or
That the holder can no longer be permitted to have the firearm or ammunition to which the certificate relates in his possession without danger to the public safety or to the peace; or
That the holder is prohibited by this Act from possessing a firearm to which section 1 of the Firearms Act applies; or
That the holder no longer has a good reason for having in his possession, or for purchasing or acquiring, the firearm or ammunition which he is authorised by virtue of the certificate to have in his possession or to purchase or acquire.


Yeah, I know, they are subjects, not citizens, no real rights, etc.

WOW! I'm sorry to hear about your cancer. It hits home with my family too. I pray for your strength and treatment. As someone posted earlier, I hope you're able to sell to someone (or have them hold them for you) who will still allow you to shoot the rifles on occasion. Good luck with your treatment and your 15-22.

Regarding medical conditions, the police have been in touch with your GP and he will have signed off or not on your renewal, as i am sure you are more than aware. Now we all know how overworked GP's are and how well they do or do not get on with you.

That being said unless they can say that you are not following treatment or management of your medical condition and are defying medical opinions then you should not have been 'flagged' by the GP. Medical conditions such as epilepsy or depression are not automatic reasons for denial of an FAC...if you are effectively aware of and in control of or managing your condition then it is grossly unfair and discriminatory to automatically deny your renewal due to a pre existing declared medical condition.

I am no lawyer, I am no doctor nor am I a firearms officer, however this seems incredibly unfair and unjust...if i were you i would contact David Barrington Barnes, who is a lawyer specialising in firearms laws from the perspective of firearms owners. He will give free initial advice regarding your particular case.

Give him an email, what do you have to lose as it stands now you have lost your firearms.

Please, forget all other circumstances and focus on getting your health back. Nothing else matters. I am a 3 time cancer survivor. It will take all your concentration, focus, you can do this. Everything else is way down the list of importance. Billy

wow, in the states, if your denied your firearms purhasers identification card (in NJ at least) your allowed to submit in writing a request for explanation as to why your permit was denied. I'm not sure if they would just give you a standardized one size fits all answer, but it may be worth seeing if you have access to an appeal process; your doctor could help chime in as well.
In fact, there's a section on the permit that asks if you've been denied before and has a section for why; and I believe if you have been denied, leaving the section blank is grounds for the issuing entity to deny the permit.

Don't want to go here but the only reason I could see them denying you is because most individuals put in your position would be "distressed" and they could make an argument about your own "personal safety".
I don't think it makes much sense considering it's a treatable condition. Your doctor could even make the argument that it would be beneficial to your mental health. Keeps you engaged and interested, helping improve your health either physically or mentally given the situation


Nonetheless, I Hope the best for you, and like others have stated, focus on your health.

Keith,

Just put my renewal paperwork in and as you may know my local force have a reputation for being very slow with this type of thing. 2nd slowest in UK Last I checked.

My FAC expires in August so thought if I put in for it in Feb it may actually be ready on time.

Would you believe within 3 days, I had a letter saying that, as I had declared a medical condition (Heart Condition) they would now contact my GP to ensure blah blah blah....

Oddly, I had the same condition when I first applied for and was granted both my shotgun Cert and my FAC, only now do they seem to want to contact a doctor. What a joke.

I wonder how they will view my request for a further 8 rifles in various calibres and 6 sound mods. Hahahaha

I think it is fairly obvious the direction that this whole private ownership of firearms is going in this country.

The latest home office price hike of the renewal for a clubs firearms cert from £80....to £900 seems designed by intent to price out the smaller clubs and to put a major dent in the larger clubs ability to sustain itself after such a colossal fee.

As a committee member of my club and captain of the rifle team i see many newcomers to our sport and a good 50% do not get the go ahead from the police to even attend, let alone obtain a firearms licence. They are being much more stringent than they have ever seemed to be.

I was talking to one of the 'greys' at our club about this whole situation and although i highly doubt that what he imagines the future to hold to come to fruition, he was going on about 'getting rid of people who are trained with firearms on a civilian level will lead to the lack of a home guard'...as a former high ranked army officer, his world view is a bit jaded. However it seems that the powers that be would be a lot happier if private ownership of firearms were not allowed...to whatever end.

First of all, don't give up. Advances are being made in cancer treatment every day. There's always a chance.
My best friend is currently battling cancer. His determination to beat it is an inspiration to me. I'm sure he will win.

As your countryman, Mr. Churchill said:
“Never give in. Never give in. Never, never, never, never—in nothing, great or small, large or petty—never give in, except to convictions of honour and good sense. Never yield to force. Never yield to the apparently overwhelming might of the enemy.”

As for your firearms license, I'm just flabbergasted. Why should your health even matter? Surely there must be some way to fight that as well. Refer to the above quote.
