BG380 no manual safety not MA legal

I wanted to take advantage of the S&W rebate and get a Bodyguard 380 no safety before the rebates end.
Checked the S&W website and it shows on the MA approved page that the shield,SD/SDVE, and BG380 are available with or without manual safety. Go to my LGS and am informed that the BG380 no safety is NOT approved for MAssachusetts. I wrote to S&W to complain that their website is misleading. This is what I get back for response:
"That would be a decision made by the state of MA firearm roster, unfortunately I am not sure why it wasn't included.
Smith&Wesson values its customers and we are happy to have served you today. Please do not hesitate to contact us should you require further assistance."

It may be misleading but i would blame Massachusetts not S&W. All these manufacturers have to jump through hoops to get to sell in Massachusetts

If you look at the Approved Firearms Roster, dated 03-2017 at http://www.mass.gov/eopss/docs/chsb/...ter10-2016.pdf it lists only "Bodyguard 380", not any specific model. I think I'd try a different shop.

That's the same thing I found.

And I did not see a "MA approved page on the S&W website"

I found a State Compliance page that lists pistols for CA & MA, but did not see any BG that said it was MA Compliant.

I seen a 45 Shield and a few others that say MA compliant.

There is a drop down bar for different states. Pick MA and the page displays all the guns that are legal for sale in MA. I think I will try another gun shop.

The safety is low profile and positive in it's position. i.e It takes a conscious effort to flip it on and off. You can always opt just not to use it if you chose.
Personally, I fell the manual safety combined with the long DA pull is what makes the BG380 such a perfect choice for pocket carry.
In any case, MA is not likely to get this straightened out before the rebate window closes.

I'm not holding my breath for the rebate. MA gun laws suk.
