Default Finialy after 93 days

Today I got the phone call I have been waiting on.
DOJ called me and told me I was good to go, So I went down and filled out another DROS and paid another $25, This brought my fees up to $92....
The main case that was holding me up was a wrong defendant case....
So on the 26th I get to pick up my MP 15 Sport 2 And I got it for the original price I paid for it....I never let them refund the funds to me, I told them I would be back to get my Rifle....

I pick up my Rifle on the 26th, Can't wait....
Morale of the story is, When ya get Divorce, Don't leave an old ID behind for the ex to give to a low life Boyfriend, I came real close to going to Prison over that....

Wow...93 days was about how long it took for my ATF paper work to come back when I got my first silencer.

Ugh! I will keep my ID to myself should I ever find myself in the situation you describe. I don't expect it but gee whiz, things can really go screwy on you if someone wants to mess with your life.

Congrats on sifting through the mess. I know others who haven't fared so well. Usually it's with something that hurts even worse than guns though - children. It can get so ugly.

Mike G 0351, I am glad everything was straightened out enabling you to finally get your AR.

C J, I know this feeling very well! Let's put it this way, the judge saw right through my ex wife and I was granted sole parental custody!

OK, that makes sense. I'm not sure, but I think CA is the only state that has the DROS process.

You shouldn't have had to pay DROS twice if it was just a delay. Were you denied? I guess that would be different. You don't have to answer and I'm not trying to pry into your business. I'm just glad you got it sorted out.

Rastoff....
I was not denied, I had the 30 day delay and it came back undetermined.
And then they got copys of my court papers and they said Wrong defendant on them, So they called me and said I was good to go, But after the 30 day delay, The original DROS was canceled, So I did another one on the 16th.
But Im with you, They should of told the LGS to just release the rifle since I already paid for the DROS once and a Livescan....
The LGS tried to give my funds back a couple of times, But I'm a stubborn Old Marine and I told them no, I will be back for my Rifle....

I'm going to have to look this up, but I think you got caught by some ignorance on the part of your dealer. I seem to remember reading that if a determination took longer than a certain period of time (I don't remember what the period is, but it's less than 30 days) and was still undetermined (meaning they can't prove you're a criminal) they are supposed to release the gun.

It's moot at this point because you have your rifle now. I do want to look it up though.

I don't pick up my rifle untill the 26th.
But if the DOJ after 30 days, Declares you undetermined, The DOJ leaves it up to the dealers discretion weather to release the weapon our not, And they wont because they may be liable....
