I went to "The Nation's Gun Show" today. It was really crowded and prices generally sucked (ie $570 for a new Glock 19, and people were happily paying it). However, I did locate an SW99 .40 that is one of the LE trade-ins that are out there right now. It appears to be unfired and uncarried (no holster wear or visible lockup marks on the barrel), and has night sights that appear to be working (I put my hand over the sights and they were glowing). It includes the original box, and two 12-round mags. No extra backstrap, books, etc. The one cosmetic defect on the gun is a few small nicks around the end of the barrel. Is this something to be concerned about or pure cosmetics? As for the price, it was marked $419 but I was immediately told by the dealer that they'd take $399, which tells me I could probably go lower. What would be a good value for this gun?

It is a good price for a 99, but then consider that a new M&P can be had for around $500 and get a $50 rebate.

That's exactly why I didn't buy it yesterday. I can get an M&P40 (which I know I shoot well, I haven't ever fired a 99-series pistol) for just over $500 after FFL transfer fees and then get two extra mags free or a $50 rebate. That would also come with the peace of mind of having a guaranteed new pistol as opposed to this SW99 that has an unknown history. But on the flip side the SW99 has night sights and does offer TDA functionality.

FWIW:

CDNN sells these suckers all day long at a very reasonable price.. You might check 'em out.

FWIW (again) I had a Walther P99/AS and it was a fine pistol... Amazingly accurate and 100% reliable. The SW99 is basically the same pistol with the exception of the barrel and slide mfg. by S&W.
