That is on the high side of the range, but considering it is NIB and 3rd gens are getting harder to find the price isn't out of line. If you are looking for a good compact 40 cal it would do nicely.
I would first make sure it is NIB. There will be some carbon from being factory tested, but there shouldn't be too much. Also look for a circle from the face of the slide where the firing pin comes through the size of a 40 cal cartridge. If it has been fired a lot that circle is really hard to clean off. It shouldn't be there on a NIB model. A final thing to watch for is if it was a display model, it will have been hand cycled a lot. None of these are deal breakers, they just reduce the value in my opinion and no longer classify it as NIB.
Anyway, if it is actually NIB, try talking them down a little, otherwise it is in the fair price range, even if on the higher side of that range.
