Default Bodyguard 380 magazine not holding up slide catch/release lever.

I recently purchased a new Bodyguard 380 - not the M&P version. I've got about 350 rounds through it and am having problems with the magazine not pushing up on the slide catch/release lever. The follower of the magazine is not hitting the lever. This now happens around 70% of the time. I've read about a mag upgrade that can be done to hold 1 more round that also resolves this problem, but I shouldn't have to buy something else to fix this, or is that the only way? It happens with multiple mags - all are OEM S&W.

I'm a novice, but I have a BG 380 as well purchased this spring. It has maybe 4-500 rounds through it. I've noticed that when the clip is empty, the slide lock rarely locks back automatically. I purchased an extra clip, but only have the s&w clips (the two from factory, and one extra). It no longer locks back automatically when there's no clip and i just slide the lock back (a feature it had in the store and for a bit after i brought it home).

As far as I know its a design flaw and it has been well documented by several gun demo's on youtube gun ...I sent mine back to S&W to be repaired...it still has the problem of intermittently not locking slide back on last shot. I have tried stretching the spring and reversing it too...it just made the problem worse. I fixed my problem by installing the MagGuts high capacity conversion kit. It increases the mag capacity to 7 rounds and it comes with a metal follower....check out gallowayprecision.com for availability....they cost 22.50 ea plus shipping....
