Default Yard sale find

When browsing a yard sale and you see a blue box you investigate and then ask how much. When the man tells you what he wants for it and you don't argue, you pay him what he wants, then you run home and fondle what you just bought., A nice model 41 all boxed with all papers and 3 mags. dated to 1978.
The photo does not do it justice. Oh ya did I mention it was 450.00

Isn't it nice when you find a seller that doesn't have a computer..

I wish I lived in an area where people can sell guns at yard sales. All I find are occasional smithing tools.

Can you do that in Montana? NO WAY here in Washington. All firearm purchases MUST go through an FFL Even private "garage sale" buys. Some wiggle room if gifted to a family member or part of an estate left to family member or other as noted in a will. Even deals between friends is a No No. Enforcement is a problem I would guess especially with C&R older pieces that were never registered. If stolen and used in a crime the weight of the law would be on the last REGISTERED owner. BIG trouble if not transffered correctly after this new statute came in in 2016 I believe.

That was one heck of a buying price on that M41. Good for You. WE are all Green with envy on what you paid. You can probably double your money over night just by selling this gun the way it sits.

Mind-boggling... about the same as winning the lottery.

That deal sure as heck would never happen around here... not in a million years.

I bought a M41 with box, docs, tools, and 2 mags for $300.00 + tax.

It was 1981. Don't you feel a tiny bit guilty for taking advantage of the seller? I wasn't there, but I've met sellers who deserve exactly what happened -- arrogant 'Know-It-Alls' with no knowledge of prices.

Yes perfectly legal. It’s interesting when people that choose to live in states with unreasonable rules some how think everyone else that live in states without those rules must have to obey their states unreasonable rules. Those of us living in Free America buy with glee and enjoy rare finds like this one.

Oh man, what a deal, on both pistols shown! I just love it when someone stumbles in to a great deal like that. I've done it once or twice, and you have to walk away and pinch yourself to make sure that it isn't just a dream. Congratulations!!

Wow, what an great deal, enjoy it for a long time!

Ah, I remember the good old days here in Colorado (prior to July 2013) when we were free to make deals without any interference.

Default Yard Sale

Haven't been on in a while, forgot my pw and my ISP would not let me follow instructions from the Forum to reset. Now on as a newbie.
About three years ago I was getting ready to sell my house in Alabama and move to another location in the state. Pulled out some guns I did not want to move with me and had them on a table at our yard sale.
A neighbor I did not know came by and blew a gasket telling me I can not sell guns and was going to call the police. Sure enough she did and sure enough two police cars showed up. They bought three guns

So, you did a background check to make sure it's clean? I wouldn't want to be in your shoes if it's stolen. Good luck.

#2: And if it is stolen.......what? Are you suggesting that the buyer will be subject to prosecution? Maybe in PRM but in most states (mine I know for sure) if he bought it in good faith, he won't be prosecuted. He would also be well within his rights to sue the seller of the pistol.

Not sure why everyone is so excited about a private, person to person transaction. It IS still legal in many places.

I mean, this is till America, right?

OP enjoy that pistol. Either shoot the heck out of it or turn a nice profit. You earned it.

People who live in MA are used to a high level of scrutiny, so they often don't see how it's done in real America. In MA, you have to have a license just to buy ammunition.

A face to face transaction requires that both parties enter their license information into the state database before they can proceed.

When I travel to the south and talk to people in gun shops or show I tell them what the laws are in MA regarding gun sales.

Much of the time they think I'm doing some sort of comedy routine at first. Then, once the realize I'm serious, they ask me why I still live there?

Take a breath! I'm saying I'm too cute for prison. Ever hear of Receiving stolen property? Maybe where you live in the wilds of whatever territory your from, but here in the 50 states we have laws. Stolen property is stolen property.

I'd rather know I'm safe when I do a transaction no matter where I am. I have nothing to hide. Unfortunitly, the other states are going the way of Massachusetts. I can still walk into a shop, put down my money and walk out with said firearm. No 10, 15 or 20 day waiting period. By the way, try and buy a gun or carry in the states while your on the road with your comedy routine.

I agree. No need for the Debbie Downer thing here. We are all adults. None of us wants to end up with a stolen gun. I sincerely doubt the subject Model 41, complete as shown, is a stolen gun, but there are certainly ways to check it out.

So sad... so true. What's it called? The Stockholm syndrome? Some folks here behind enemy lines start to believe that our oppressors are right. When we leave the state and see what life is like in the real world, it sometimes floors us.

TTSH, you'll like this: I went in to get a haircut this afternoon, and my barber, who knows I like S&Ws, shows me a 4506-1 with 4 magazines, a holster and a couple of boxes of ammunition that another customer is wanting to sell, and had just dropped off. I ended up with one of those John Edwards priced haircuts!! I'm not even really into the 3rd generation Smiths, but just wanted the poor thing to go to a good home. (Mine)!!

Best Regards, Les

To Allen in MT and Les in WV = congrats!!

To those in MA... you have my most sincere condolences. I knew it was bad but I had no idea it was that outrageous.

This must be the "barber shop loophole" that we hear so much about.

I would love to do that. I always find the old half tin of NATO 308 ammo that the owner insists was Napolean Bonaparte's and wants a premium for. Congratulations!

So in Utopia things don't get stolen? I'm not saying it is stolen, just saying. Last comment, I think it's really sad that people have to attack someones location when they don't agree with someone else's opinion.

True, but a nuisance rather than a game-stopper. Recently bought a Ruger MkII Target stainless with 5.5" bull barrel, two mags and instruction book FTF from a fellow club member for $100. Just put a couple of PINS into the state web site, THEY filled out the forms except for the gun info, I printed off a couple of completed FA-10s. The software worked fine, so this is obviously post-Deval.

The state is wrong, the pro-2A folks are right, and MA is mostly not the place for someone who wants the latest 30-round crunchenticker. But it is livable for some folks, and has far fewer no-carry places than most "free" states.

Gun laws are one of the most important issues in deciding where to live, but they are not the only one.

Gun Club Fan,

All I can do is laugh at you guy. In order to charge receiving stolen property, you have to prove knowledge or intent. I mean, you show a cop badge so you know that, right? Or were you the type that just assumed they KNEW it was stolen?

And I'm pretty sure "your" oh wait, "you're" the one that needs to take a breath, lolololololol.

Lastly, you talk about attacking someone's location, but say "the wilds of whatever territory your from".........really?

I really feel bad that living in Mass has got you so torqued about private transactions that you get on here and pontificate and allude that the way you do it is superior to everyone else.

OP, in spite of this guy's fear of your pistol and how you obtained it, please enjoy it. I think you got a smoking deal in spite of the fact that it scares some.

Instead of continuing to hi jack this thread, it you have any further questions/complaints/concerns you can message me rather than derail the thread.

How do you know it isn't a stolen gun?

Relax, just kidding! Talk about a great deal. Very nice!

I'm going to bite my tongue here and not fan the fire any further about free states vs. oppressed states. I think MA is terrible beyond words and getting worse, but it's obvious that not all MA folks share my assessment. Peace!

If you quote my statement and label it an "attack" then I feel... attacked... no... triggered... Aw, heck. Who am I kidding. I don't feel "sad" or "attacked." That would be overstating the condition of an internet post on a forum.

Since we are in the subforum for S&W Semi-Autos and not politics (gun laws,) I'll just close with Nice Score to those that found them.

Great deal on a cool gun OP, yard sale guns have become a thing of the past around here as have good deals thanks to Gun broker.

The fear of “hot” guns means a national UBC is right around the corner.

We don't have any real disagreement. It's just that I realize that MA is only in the top ten worst states, and not THE worst. CA, NJ, NY, HI, MD, and DC are all worse, and there may be others. Of course, any of us are only one police chief away from having to move, but my area seems pretty stable.

I'll end my participation in the non what a nice gun part of this thread with one thought. Unless the FA10 database is hooked into NCIC, I don't see how doing one for a face to face transfer would do a thing to ensure that the gun isn't stolen.
