Default Not Pleased in NM

Our governor was able to, "...do something..." about gun crime (we have the 4th highest murder rate in the US) in her opinion. She just signed a 7-day purchase-to-pickup waiting period into law. At least there are exceptions for CHL holders and family members.

We had a good run from 1912 to now with few restrictions. This one should take effect in July.

The provisions of this section do not apply to the sale of a firearm:

(1) to a buyer who holds a valid federal firearms license;
(2) to a buyer who holds a valid New Mexico concealed handgun license pursuant to the Concealed Handgun Carry Act;
(3) to a law enforcement agency;
(4) between two law enforcement officers authorized to carry a firearm and certified pursuant to federal law or the Law Enforcement Training Act; or
(5) between immediate family members.

Murders per 100,000 population

Mississippi - 23.70
Louisiana - 21.30
Alabama - 15.90
New Mexico - 15.30
South Carolina - 13.40
Missouri - 12.40
Illinois - 12.30
Maryland - 12.20
Tennessee - 12.20
Arkansas - 11.70
Georgia - 11.40

The legislature also increased 2nd degree murder and attempted 2nd degree murder penalties, requires incarceration of anyone committing a felony while on bond for another felony, and banned firearms from within 100 feet of a polling place during elections except by CHL holders, pollworkers, and LE.

Your governor is an idjit but your legislature seems to have the right idea.....

Some interviews with Democrat Senators and representatives early on said they would not vote with her on some of her plans like Semi-Auto bans, magazine bans etc. They said they would not vote for anything unconstitutional. Glad to see that. NM is a state full of gun owners, one of the highest per capita in the US and a huge hunting and shooting culture. Her original plan was a 14 day waiting period but that was whittled down in committee. Sadly it made it through as modified.

So some MN legislators said they would not vote for proposed laws that are unconstitutional?

I'm still waiting for someone to find the section in the constitution where it says that exercising 2A rights can be delayed by 3, 7, 10, 14, 30, etc. days. So legislators who say they will not vote for anything that is unconstitutional, yet vote for waiting periods, government mandated firearms training, bans on certain types of firearms, etc. are voting for unconstitutional laws.

From my experience in the criminal justice system, if they want to prevent violent crimes they should put a two week hold on liquor store purchases. They tried something like that once but it did not pan out.

I can sort of see how these “igits” might honestly believe that a cooling-down period might be of some use if applied strictly to first-time buyers. Constitutional or not, the thought has at least some basis in logic and human nature. Applying that mechanism to persons who already own guns is outright ridiculous. We did that here in Indiana for many years, then somewhere, somehow the light must have been switched on and we got away from it. I can’t recall when.

A shame that an operation of term limit law has to expel her rather than the will and indignation of the people.

There should be city law and country law. The liberals control all the cities so let them live by their own draconian ideals and ban guns while inviting in criminals and their lifestyles.
Rural people don't have the same values as city people and should not have to live under the same rules/restrictions.
Unfortunately the cities have such large populations that they easily outnumber rural voters and so you get what we have today: city rules for all.

I was a NM approved CHL instructor in NM, lived in Silver City.
The recommended curriculum included a live fire session and qualification (not a bad idea), but the class was recommended to be 15 hours!
Then it was mandated that instructors were to attend 8 hour 'inservice' training that, if I recall correctly was annual.
The sessions were held all over the state, the closest being 2 hours away for me.
So, drive 2 hours for an 8 hour mandated session, then 2 hours home. Sounds like an overnight stay. Too many hoops to jump through so they rescinded my instructor status. Happened to a bunch of instructors, culling the herd.
Moved to AZ 5 years ago, much better.

I've said that for years. If I get angry at my neighbor, I'm not going to buy a new gun to shoot him.

I wrote to my legislators in Maryland about that concept and was told that they are concerned about safety and that all steps needed to be taken. They don't care.

If our elected representatives are all concerned about safety, when then are they going to take positive action on Distracted Drivers? Or any other “safety” concerns for which “all steps needed to be taken”……..
Y, this is not directed to you , just our mutually elected officials that pick and choose what “safety “ issue is more likely to help them stay elected……regardless if they do anything about them…..

The evil twin of that NM Governor, Katie Hobbs of AZ, just vetoed a new law; the 'Alien Invasion Act'. It would allow police to arrest illegal border crossers. It was passed by both houses of Congress.

If so, ya' recon the courts will strike her down again?

Nope - HB 129, passed the House 37-34, passed the Senate 23-18. Gov. Grisham signed it yesterday.

I've never heard of SCOTUS cases on waiting periods - anyone out there know of one?

I don't see it happening in NM.

So the governor just signed the bill into law but the bill came about through legislation? The Governor just didn't do a waiting period by fiat?

Grisham has cranial rectal inversion. Major league fool.

She's passed junk that the vast majority of the county sheriffs told her they wouldn't enforce. Don

Unfortunately the cities have such large populations that they easily outnumber rural voters and so you get what we have today: city rules for all.
As I have pointed out before, you can thank Earl Warren for that. Apparently an electoral college type system is OK at the Federal level, but not within a state. You must have one person, one vote. It will be a brave person who takes tha to SCOTUS. Think about it a little.

...and I thought it was just Nevada where a certain group has the bizarre habit of putting forward unelectable candidates.

These laws make sense as they don't punish responsible gun owners.

I was in law enforcement for 20 years. I live in Colorado (aka California east) where in October our Newsom puppett Gov started a 3-day wait. At least if you have a CCW permit there, its waived. No one is exempt here except LE. I can tell you if someone is intent on killing themselves or others with a LEGALLY purchased firearm, a "wait" isnt going to stop them, they will plan accordingly. These laws are nothing but a sloppy attempt to either 1. trip up sellers into making mistalkes on releasing/paperwork records the weapon, hence loosing ther licence. 2. Slowing down firearm transactions as a whole and 3. making it less convienient and generally more annoying for anyone who can legally purchase a firearm, and those who sell them, big or small who chances are aren't politically aligned with those who wrote the laws anyway.

Sad isn't. They keep passing laws to hamstring us. We just have to somehow get rid of these people or they will tax us to death and take away our guns completely. I am Also from the people's republic of Colorado.

I bet someday the same thing will happen with the Office of President.

Maybe even get another one who is pushing 90 that runs.

I mean, both those things can happen- but probably never would in this Country.

Curious on two items -

Re "FFL exemption" - does that apply to C&R FFLs when buying "old guns"? If not the state legislation has just negated an FFL license. Also, under the theory that a law is supposed to (even in theory) accomplish some sort of positive end and be narrowly crafted when affecting a right, how does a waiting period fit into that box when a person already has guns?

We had a good run from 1912 to now with few restrictions. This one should take effect in July.

The provisions of this section do not apply to the sale of a firearm:

(1) to a buyer who holds a valid federal firearms license;
(2) to a buyer who holds a valid New Mexico concealed handgun license pursuant to the Concealed Handgun Carry Act;
(3) to a law enforcement agency;
(4) between two law enforcement officers authorized to carry a firearm and certified pursuant to federal law or the Law Enforcement Training Act; or
(5) between immediate family members.

Murders per 100,000 population

Mississippi - 23.70
Louisiana - 21.30
Alabama - 15.90
New Mexico - 15.30
South Carolina - 13.40
Missouri - 12.40
Illinois - 12.30
Maryland - 12.20
Tennessee - 12.20
Arkansas - 11.70
Georgia - 11.40

The legislature also increased 2nd degree murder and attempted 2nd degree murder penalties, requires incarceration of anyone committing a felony while on bond for another felony, and banned firearms from within 100 feet of a polling place during elections except by CHL holders, pollworkers, and LE.
This is the cost of "compromise" on supposed gun control laws across the board. Democrats are the "Party of Taking Things Away", including guns and gun rights. Sorry to see this happening to to you.

We need to be proposing and fighting for increased liberties, not constantly fighting some defensive action to limit the march towards civilian disarmament.

That is the current face of our 2 party "democracy" Poor choice #1 vs poor choice #2, go to the polls and vote for the lesser of 2 evils, despite the fact that the lesser of 2 evils is still evil.

Unfortunately most candidates are to stupid for the job, yet dumb enough to want it.

I always ask myself this "would I lend this person $20 and expect to get it back?" If not why expect them to be honest with our national budget? Consequently, I seldom vote for any member of a major party member on the national level. State level is a bit better, and I do have some what better choices on the local level.
