Default Morris v. Army Corps Order

Not sure if I should have posted this here or under 2nd Amendment.

A motion for preliminary injunction was granted.

http://ia800902.us.archive.org/4/ite...32180.42.0.pdf

This is an order of the UNITED STATES DISTRICT COURT FOR THE DISTRICT OF IDAHO.

Do any of you have an opinion (hopefully with some knowledgeable legal backing) as to whether this order applies just within the jurisdiction of the Idaho court or would it apply nation wide including here in Nevada?

Story here: Right to Carry Guns on Federal Recreation Areas, and Right to Possess in Tents on Those Areas | The Volokh ConspiracyThe Volokh Conspiracy

Quote:
Today’s Morris v. U.S. Army Corps of Engineers (D. Idaho Jan. 10, 2014) strikes down an Army Corps of Engineers regulation barring possession of loaded guns in recreation areas surrounding Corps dams. The court holds that tents are akin to homes, where Second Amendment rights are protected. The court also holds that the Second Amendment protects the right to carry guns as well as to possess them at homes, so that the regulation is unconstitutional even as to carrying outside tents. And the court rejects the argument that the government may restrict such gun possession and carrying on the grounds that the government owns the property, and has no obligation to open the property to the public in the first place.

28 years ago this Memorial day weekend, I portaged a canoe across a COE dam. The "Ranger" saw my Mini-14 folder on my portage pack and said,"You can't have that here", I replied, "It's okay, I'm not here" and just kept going. It is ridiculous to prohibit firearms at a dam, when they are completely legal on the rest of the river. My very limited experience with COE employees in the last 30 years is, many or most are not in the United States Army, and never were! The actual engineers are just bureaucrats, and enjoy just being self important pains! Many of my civilian engineer friends, find them harder to work with than the IRS. You know the COE is going to claim "National Security" for their dams tto try and continue their ban on guns. Sorry this won't help answer your question. Ivan

Default Federal Courts

US District Court decisions are binding only in that District. US Court of Appeals decisions are applicable anywhere in the Circuit where heard. US Supreme Court decisions are applicable throughout the US of A.

Lawyers among us, please feel free to restate if my wording is confusing.

Be safe.
