It is considered an "AOW" by the ATF and requires a $5 tax stamp.

ETA:
does it shoot regular .38, or is it for tear gas?
If it has "Police Equipment Corporation Chicago", with pocket clip is marked "Pat. Sep. 5-16 Parker" then it is pronbably NOT made for bullets but tear gas rounds!

Thanks. Can't seem to find any info on-line Would not have suspected tear gas if you hadn't suggested it.

Yeah, most ballistic pens that fire real ammo are generally chambered in much smaller calibers.
Don't think I've ever heard of a pen chambered in .38 for regular ammo.
Bet that puppy would kick!

Ive seen these for sale from time to time at gun shows. They seem to still be made as all the ones I saw were new. Anyway, ive seen them in .22, .25 and I think 9MM????/

kind of reminds me of the flare guns they used to make for sale in the 70's. Thumbed back the striker and into a safety notch. Then screwed in the flare then released the striker. Flares came in red, green and I think yellow. Way to easy to convert into a illegal firearm and I think were taken off the market. Frank
