Remington RB No. 1 no serial number?

I am attempting to work out a deal for a beautiful Remington Rolling Block No. 1 that has been re-barreled to 45-70 and is set up for BPCR shooting. It is listed as a pre-1899 action, making an FFL not required. Here's the catch, there is no serial number. What little I know about Remingtons is they should have a serial number on the barrel under the forearm and on the trigger guard. The barrel is not original and there is no number on the trigger guard. Is this legal? I want the rifle, but not enough to risk hard time.

Prior to 1968, serial numbers were not required by law, and many guns did not have them. Was your gun manufactured without a serial number? Not sure, but if there was one, and it has been defaced, the gun may be technically illegal. I believe the guns actual frame, not a barrel or replaceable loading lever, is the only legally recognized serial number location. It was common, however, for manufacturers to stamp the serial number on other parts, in addition to the frame.
Being of pre-1899 manufacture may have a bearing on whether a missing serial number is an issue, not sure.

As far as I know a Remington would have been manufactured with a serial number. Also according to a book I have on single shot rifles the No. 1 & 1-1/2 actions were produced from 1867-1917. Either way it will need a serial number to prove it is a pre 1899.
